| In recent years,school bullying incidents in China have been increasing.They are characterized by their prevalence,high incidence,social impact,and serious legal consequences,which have drawn strong attention from all society levels,including the state,government,judiciary,schools,and communities.Bullying in schools has become a major hidden danger threatening the safety of our schools.At present,China mainly relies on the Protection of Minors Act to regulate "school bullying," which is mainly protective and lacks the necessary disciplinary measures.The effective prevention and control of school bullying can no longer be ignored.It is urgent to adopt comprehensive management based on legal regulation and comprehensive enhancement of public awareness of prevention and control of school bullying.Given that school bullying behavior at home and abroad presents some common features,the experience of legislation and other measures formulated by some developed countries on school bullying can be appropriately borrowed to help correct and improve the governance of school bullying in China.China is still in the stage of establishing and improving special laws and regulations on school bullying.By collating and explaining the views of academics on regulating school bullying,we try to analyze the causes of school bullying from multiple perspectives and.Simultaneously,combining the actual situation of insufficient legislation and disciplinary mechanisms in China suggests that we should step up the formation of a prevention and control system on school bullying laws and establish a standardized prevention mechanism.Besides,it is recommended to improve the supporting remedies for bullying in schools.By preventing bullying in schools,we can create a safe and harmonious environment in schools and promote the healthy growth of school students.In a comprehensive rule of law country,the problem of school bullying ultimately needs to be solved by means of the rule of law.This paper explains the background and significance of the study,analyzes the current situation of the legal regulation of school bullying at home and abroad,defines the legal concept of school bullying,analyzes the main types and characteristics of school bullying and the current situation of the legal regulation of school bullying in China.The shortcomings of China’s laws regulating school bullying are explained in four aspects: lack of legislation,irregular handling procedures,ineffecti accountability,and lack of supporting measures.Then,we take three countries that are more mature in dealing with school bullying,the United States,the United Kingdom,and Japan,and summarize their advanced experience in the legal regulation of school bullying,and select the contents that can be learned from them,taking into account the actual situation in China.Finally,based on the legal problems that exist in the process of dealing with school bullying in China mentioned in the previous section,strategies and suggestions for regulating school bullying are proposed in a targeted manner.Specifically,the formulation and revision of special laws,the unification of top-down disposal standards,the clarification of the legal responsibilities of each subject,and the further improvement of the laws and regulations on school bullying.Starting from defining the concept of school bullying,this paper analyzes the current situation of legal regulation of school bullying in China by combining the characteristics presented by school bullying in China.At the same time,by appropriately drawing on the rule of law experiences and measures of representative countries on regulating school bullying,we propose more targeted suggestions,namely,to improve the legal regulation of school bullying by formulating and revising special laws,unifying the top-down treatment standards,and clarifying the legal responsibilities of all subjects. |
