With the popularization and development of the mobile Internet,online shopping appears in people’s lives and continues to develop.Since the creation of WeChat in 2011,after 9 years of continuous efforts,the number of its users has continued to expand,and many users have also begun to purchase goods on the WeChat platform,so WeChat shopping was born.Due to the low barriers to entry for micro-business operations and no need for realname authentication,its development speed is far beyond the traditional e-commerce shopping model.As a new type of shopping model,it is immediately loved by the majority of netizens due to its convenience and speed.It brings great convenience to consumers,but also creates new legal issues and protects consumers’ legitimate rights and interests.The problem.This article focuses on the transaction between individual sellers and buyers on the WeChat platform,namely the C2 C WeChat shopping model.Based on the differences between the WeChat platform and traditional online shopping platforms,further analyze the legal status of buyers and sellers in shopping on the WeChat platform and the legal relationship between the parties with the WeChat platform,and further analyze their responsibilities after discussing the legal nature of the WeChat platform.WeChat shopping is different from traditional online shopping.Wechat business operators do not need to register with their real names,and there are no restrictions on the release of product advertisements.However,due to the lack of relevant laws and regulations,effective supervision,and a sound industry self-discipline system,there are often cases of infringement of consumer rights in WeChat shopping.Consumers often have no way to file complaints because they cannot obtain the true information of WeChat business operators,and there are no relevant laws and regulations to regulate shopping behavior on social platforms.Legal regulation of WeChat platform shopping to protect the rights and interests of consumers is urgent.This article takes the platform responsibility under WeChat shopping as the research object,first discusses the concept,characteristics and particularities of WeChat shopping,analyzes the legal status and legal relationship of the parties in WeChat shopping,and further discusses WeChat platform shopping and traditional online shopping Secondly,we analyze the legal nature,legal status and responsibilities of the WeChat platform in transactions;thirdly,we use our experience in the laws and regulations of shopping on social platforms in the United States,Japan and other countries and regions to provide us with Countries provide guidance.Finally,corresponding measures and suggestions are put forward in response to the problems in WeChat platform transactions,in order to strengthen the responsibility of the WeChat platform,with the purpose of better protecting the legitimate rights and interests of consumers shopping on the WeChat platform.This article is divided into four parts:The first part first introduces the concept and characteristics of WeChat shopping,analyzes the difference between WeChat shopping and traditional online shopping platform shopping,and the legal status and legal relationship of all parties in WeChat shopping;The second part discusses the nature of the WeChat platform.Because of its social nature and transaction nature,it discusses its legal status in WeChat shopping and establishes its status as an independent intermediary service provider.So as to further discuss the principle of liability and the form of liability;The third part analyzes the current status of legal regulations on shopping on social platforms outside the territory,taking the Facebook in the United States and the Line social platforms in Japan as examples,drawing lessons from experience and putting forward some enlightenments to our country’s legislation and practice;The fourth part proposes several countermeasures and suggestions for strengthening the responsibility of the WeChat platform in WeChat shopping,mainly including the establishment of relevant laws and regulations on social platforms in the legislation;in the system design,perfect the real-name registration system and establish the credit of transaction activities Evaluation mechanism,strengthen the supervision of payment security,establish an online settlement mechanism for WeChat shopping disputes,and establish an advance payment system for the WeChat platform,etc.
