In recent years,with the continuous progress of Internet technology,China's e-commerce has achieved leapfrog development.Under the promotion of Internet technology and e-commerce,wechat business,a new e-commerce model,came into being.Wechat business is a new transaction mode based on mobile Internet technology and social platform.In wechat business transaction,consumers can often complete a transaction when they browse the news of their friends or talk with their friends.Based on their trust in their friends,consumers can save time to select and compare goods on traditional e-commerce platforms,which brings great convenience to people's work and life.The emergence of wechat business not only brings convenience to consumers,but also causes some problems that infringe on the legitimate rights and interests of consumers.Under the current situation that the supervision system of online social platforms is not perfect,how to reasonably and effectively regulate wechat business is an important issue for the protection of consumers' rights and interests.In the first part of this paper,the basic definition of wechat business is firstly defined,and the micro-agreement in this paper is specifically defined as the transaction on WeChat social platform.Secondly,according to the differences of wechat business operating subjects,two operating modes of wechat business are summarized,namely B2 C mode and C2 C mode.In addition,the legal status of wechat business operators,consumers and WeChat social platforms is analyzed to provide the basis for the discussion in the following part.The second part describes the specific manifestations of consumers' rights and interests being damaged in wechat business transaction at present.For example,consumers' right to know is limited,the right to security is difficult to protect,the right to privacy is violated,the right to withdraw is unable to be exercised,and the right to claim after rights and interests are damaged is difficult to realize.And from legislation,administrative supervision,judicial relief and wechat business related to the main body of four aspects of the analysis of consumer interests damaged reasons.The third part is to sort out the relevant experience of foreign e-commerce regulation andget the enlightenment of wechat business regulation.Overseas regulation measures on e-commerce based on consumer protection mainly focus on establishing the market access system for operators,ensuring the safety of online trading environment and consumers' right to know.For example,in the oecd's "recommendations on consumer protection in e-commerce",it mentions the recommendations on protecting consumers' right to know and the online disclosure obligation of operators.Japanese legislation has adopted a strict market access system for business operators,requiring both B2 C and C2 C business operators to go through registration procedures.The fourth part is based on the first three parts to put forward the regulation path of wechat business from the perspective of consumer protection.Firstly,relevant laws and regulations should be improved to include wechat business into the adjustment scope of existing laws and regulations,clarify the legal status of wechat business operators and consumers,clarify the obligations and responsibilities of WeChat social platform,and improve the distribution system of burden of proof in wechat business.Secondly,administrative supervision departments and social platforms should cooperate with each other.By establishing the access system of micro business market,strengthening the supervision of wechat business trading environment and trading funds,improving the credit evaluation system of wechat business operators and other measures,the pre-event,in-event and post-event supervision system of wechat business trading can be formed.Finally,the relief mechanism should be improved after consumers' rights and interests are damaged,such as the establishment of wechat business online dispute settlement mechanism and the establishment of small consumption litigation court.In addition,the socialized governance in wechat business supervision should be strengthened to give play to the role of consumer association in wechat business supervision.
