Abstract/Summary:
Marx’s thought of socialist rule of law is under the irreconcilable contradictions in capitalism.Arising and developing gradually in the vigorous development of the proletarian liberation movement.His rule of law thought drew nutrients from the ancient Greek and Roman legal thought including Aristotle.It draws lessons and criticizes the modern bourgeois thought of rule of law:Rousseau’s theory of human rights and social contract,Kant’s "Pure Reason",Hegel’s philosophy of state and philosophy of law.Imaginary socialist thought has brought infinite inspiration to the construction of Marx’s socialist rule of law thought.Marx’s thought of socialist rule of law is based on deep criticism of capitalist rule of law as the logical starting point.He believed that the capitalist rule of law only serves capitalism,Because the bourgeoisie will interfere in legislation and the judiciary for his own benefit;The rule of law of the bourgeoisie only preserves equality within the bourgeoisie.For the proletariat and other classes,Equality as portrayed by the bourgeoisie is a mere illusion,The bourgeois rule by law is a tool for the bourgeoisie to rule and exploit other classes.After deeply criticizing the capitalist rule of law,Marx constructed the idea of socialism,His core views mainly include:The rule of law is for the people,and the socialist rule of law must protect the rights and interests of the people,especially the rights and interests of the vulnerable groups.The rule of law safeguards freedom,which is the premise of the rule of law and must be protected by the rule of law.The rule of law must limit the boundary of freedom while serving for freedom.Only the socialist rule of law can safeguard the freedom of the laboring masses.Marx believed that justice is the lifeline of the rule of law.Without justice,the rule of law will become a piece of paper.The mission of the rule of law is to ensure social justice.Marx’s socialist rule of law thought has the following inspirations to build a prosperous,strong,democratic,civilized,harmonious and beautiful socialist modern country in an all-round way:On the economic front,we should establish a fair rule of law,ensure orderly competition in the Internet field,comply with public opinion,and protect the life,health rights and interests of working people;Politically,strengthening the institutionalization and legalization of democratic politics;In terms of culture,we should strengthen the coordinated development of legislation,law enforcement,justice and law-abiding to promote the great prosperity of the cultural industry;Socially,we should listen to public opinion,update laws in a timely manner,and plug loopholes that affect social harmony;Ecological civilization,strict law enforcement,to promote green water and green mountains will become gold and silver mountains.
