Research On Xi Jinping’s Concept Of The Rule Of Law

Since the 18 th National Congress of the Communist Party of China(CPC),General Secretary Xi Jinping has made a series of important statements on the legal theory,legal road,legal system and legal construction of socialism with Chinese characteristics.These statements are a whole with internal logical connections,a system with views and theories,which can be called Xi Jinping’s view of rule of law.The formation of it has its profound international and domestic background as well as ideological and theoretical basis.The basic principles of marxist jurisprudence provide theoretical guidance for it,and the thought of rule of law of successive generations of the CPC central leadership since the establishment of People’s Republic of China(PRC)is its ideological origin.The formation of Xi Jinping’s view of rule of law has gone through the stages of germination,development and establishment.Xi Jinping’s view of rule of law is very rich in content.It is related to the road and direction of legal construction,the goal and path of legal construction,and involves all levels of a country,a government and a society ruled by law,as well as all links of legislation,law enforcement,judicature and law-abiding.It is a new research dimension and perspective to study Xi Jinping’s view of rule of law from three aspects: "the path of socialist rule of law with Chinese characteristics","the system of socialist rule of law with Chinese characteristics",and "governing by constitution and governing by constitution".To study Xi Jinping’s view of rule of law,we must make clear the inherent quality and value of Xi Jinping’s view of rule of law,which enriches and develops the marxist theory of the rule of law,and points out the direction and provides fundamental guidance for the building of socialist rule of law with Chinese characteristics.
