International health assistance is an important means to deal with public health emergencies and ensure global public health security.Its legal regulation is also an important part of the international health legal governance system.At the present stage,international health assistance is characterized by an increase in the types of aid subjects,an increase in the degree of aid specialization and an increasingly important multilateral aid method.However,with the rapid development of international health assistance,there are also major legal issues such as insufficient national public health capacity,low transparency of information disclosure and difficult confirmation of international responsibility.Based on the analysis of the main legal problems in international health assistance and the existing rules system,this paper puts forward some suggestions for perfecting the legal rules system of international health assistance and discusses the countermeasures for China to participate in the improvement of the rules system.Chapter 1 of this article mainly outlines the concept and characteristics of international health assistance.Chapter 2 puts forward the legal issues arising from the practice of international health assistance.Chapter 3 combs the relevant legal rules of the existing international health assistance.After combing,it is found that the current legal rules are too general and lack a specific system design,resulting in insufficient operability of international health assistance.At the same time,there is a lack of attention to the development of core public health capacity in backward countries.On the basis of the analysis of the first three chapters,Chapter 4 of this article puts forward suggestions to improve the legal system of international health assistance,including establishing a legal mechanism for international health assistance coordination;formulating an international responsibility mechanism in international health assistance;strengthening the capacity building of the international health assistance monitoring and evaluation system based on transparency;establish a long-term assistance mechanism for developing countries.Chapter 5 puts forward suggestions on my country’s participation in the improvement of the legal system of international health assistance,including actively supporting the establishment of an international health assistance mechanism;reasonable evasion of possible international responsibilities in international health assistance;and improving my country’s domestic legal system for foreign health assistance.
