The homestead is an important place for farmers to produce and live,and it is the material support for farmers to settle down.With the continuous deepening of the market economy and the outward transfer of rural labor,the functional requirements for homesteads are not limited to rural housing security,and the need for property functions has become increasingly prominent.However,my country’s current homestead property rights system cannot meet this requirement.This article uses Marx’s land property rights theory as a guide,combined with the current situation of my country’s rural homestead use and the relevant changes in the homestead system in the Land Management Law,and explores my country’s homestead system direction of reform.This study sorts out the current research status at home and abroad,and on this basis,it studies the six parts of Marx’s land property rights theory,the changes in the homestead property rights system in my country,existing problems,the practical experience of house reform pilots,and the improvement path to analyze the homestead.The application of Marx’s theory of land property rights in China on the issue.In the first part,based on Marx’s land property rights theory,the logical connotation,practical value and contemporary development,it elaborates Marx’s land property rights theory.First,the logic of Marx’s land property rights theory is explained from four aspects: land property rights and power theory,combination and separation theory of property rights and power,land commercialization and allocation marketization theory,and land rent theory;secondly,the use of this theory can clarify the ownership of land property rights,and it is the home of our country.The "three-rights separation" of the base provides theoretical support and proposes a market-oriented orientation for the reform of homesteads;finally,combined with the logic of the reform of the rural land property system in China,a brief introduction to the theory of rural marketization is made to promote the development of homesteads towards marketization.The second part is the analysis of the changes in the property rights system of homesteads.From the perspective of the ownership and circulation of the property rights of homesteads,the property rights system of homesteads in my country can be divided into three types: the free circulation of the two rights of ownership and the right to use,the separation and disguised circulation of the two rights of ownership and the right to use,and the exploration of "the separation of three rights".stage.Combining historical social development and its main contradictions,analyze the reasons for the reform of homestead property rights system.Combining the main contradictions of the current urban-rural integration development based on the historical development context,it provides direction for the reform of the property rights system of my country’s homestead.The third part analyzes the existing problems of my country’s homestead property rights system.Combined with the new 2020 Land Management Law,it analyzes the current immature homestead property rights system framework,the unsound management mechanism,and the deviation of the system design from the development trend of urban-rural integration from the three aspects of cause,current situation and impact.The fourth part is to select typical cases from the economically developed main population inflow areas,traditional agricultural areas,and characteristic industrial emerging markets developed areas,and analyze their experience in the reform of the homestead property rights system in combination with local special contradictions,and provide a path for the reform of the homestead property rights system.Practical experience analysis.On the basis of the above,the fifth part proposes that the reform of the homestead property rights system in China must first provide protection from the legislative level,and use rural planning to lead the expansion of homestead functions,and explore the "dual paid" mechanism of homesteads in order to realize the intensive use of homesteads.Protect the rights and interests of farmers,and realize the unification of urban and rural housing land rights and capabilities under the goal of urban and rural coordinated and integrated development. |
