Legal Regulation Of The Abuse Of International Press Freedom In The New Media Environment

New media is deeply influencing the international communication pattern and the life of ordinary people.This paper aims to objectively analyze the current situation of the abuse of international press freedom,summarize the reasons for the abuse of international press freedom,sort out the legal regulations of the abuse of international press freedom,summarize the commonness and individuality of the existing legal regulations,and analyze the shortcomings of the existing legal regulations.By integrating the experience of different countries,this paper offers a proposal to prevent the abuse of international press freedom.First of all,this paper introduces the related concepts of new media,freedom of the press and abuse of international freedom of the press,and summarizes the characteristics of international news communication.This paper finds that under the new media environment,international news communication has a wide range of information sources,diverse communication channels,improved communication speed and diversified communication content.While the new media brings convenience to the news dissemination,it also brings the disadvantage of the abuse of press freedom.The abuse of press freedom reduces the authenticity of international news communication,infringes on the privacy of news parties,affects the normal development of judicial activities,and impacts the order of international news communication.After summarizing the negative effects of the abuse of international press freedom,this paper explores the causes of the abuse of international press freedom.This paper concludes that in the new media environment,the diversity of news dissemination subject affects the "organic movement" of news.In order to pursue timeliness,the media ignores the authenticity of news.The non real name system of social media aggravates the abuse of press freedom,and the imbalance of world news communication pattern catalyzes the abuse of press freedom.The progress of the legal regulation of the abuse of press freedom in the new media environment depends on the unified understanding of the limits of the abuse ofpress freedom by different international organizations and countries.Therefore,this paper summarizes the current situation of the legal regulation of the abuse of international press freedom at the level of international law and domestic law.This paper finds that the international community has gradually realized the necessity of defining the scope of freedom of the press more strictly while protecting the freedom of the press,and has regulated the abuse of freedom of the press from many aspects.However,the international community’s understanding of the reasonable boundaries of press freedom is not clear enough,and the existing laws and regulations can not fully adapt to the new media development model.The existing legal regulations and discussions provide us with ideas to a certain extent.The boundary of press freedom needs to be defined more in line with the requirements of the times,and the combination of legal regulations and its application in real life need to be recognized again.Last but not least,this paper propounds some suggestions on the improvement of the legal regulation of the abuse of press freedom.Under the media environment,the legal regulation of the abuse of international press freedom should adhere to the principle of protection as the supplement of the competent system,and improve the relevant legal system of the abuse of international press freedom from the legislative and judicial aspects.At the legislative level,we admit that a clear definition of the reasonable boundaries of press freedom under the new media environment is the basis for strengthening the construction of international press and communication legislation under the new media environment.When making the reasonable limit of freedom of the press,we should use the "obvious and immediate danger principle" to accurately grasp the critical point of the abuse of freedom of the press,correctly define the false degree of false news through "self clearing and self proving" and"mutual clearing and mutual proving",and use the "case by case weighing" principle to determine the measurement standard of the consequences of the abuse of freedom of the press.At the judicial level,we should strengthen the supervision of international news communication platform,improve the relationship between media and justice,reduce the conflict between news activities and judicial activities,and create a good media and judicial environment.Under the new media environment,the international legal regulation should improve the level of self-discipline of the industry by establishing the news appraisal system and the technical "gatekeeper"mechanism,and improve the journalists’ news literacy and moral quality by establishing the individual self-discipline mechanism of international news communication.
