Investigation Report On Judicial Settlement Of Agricultural Products E-commerce Disputes In Huitong County,Huaihua

Huitong County is located in the southwest of Hunan Province,which is a well-known national ‘green township’.Due to the lag of the county economic development,it belongs to the poor counties in the mountainous area of Hunan.Internet e-commerce has created business opportunities in the same county.It promotes the benefit of the county to achieve poverty in December 2019,but thus triggered on agricultural products the number of marketing disputes has risen sharply,it is difficult to determine the main body of responsibility for the e-commerce marketing disputes of agricultural products during the trial,and it faces many challenges when it comes to producing evidence,identifying evidence and legal facts.The effectiveness of the judicial settlement of such disputes in the grass-roots courts is not high,which has become a hot and difficult issue in the judicial work and has aroused social concern.Based on the judicial settlement of relevant disputes arising from e-commerce modes such as Zhuzhai Village E-commerce Experience Pavilion,Huitong People’s Livings&Le Cun E-commerce,Village Doctor,wechat business of agricultural products,live marketing,online mall etc.in recent years to win the battle against poverty in Huitong County.Refer to relevant cases of Huitong County People’s Court from 2017 to 2020 to understand the situation of e-commerce marketing dispute cases.Collect Judicial statistical data,visit investigation and other forms of research.Conduct statistical analysis on the trial of such disputes in the county,and summarize the focus of the trial.In view of the existing problems of civil subject qualification identification,proof and cross-examination,fact determination,long trial cycle,e-commerce legal standard operation and legal services to help the problem.Analyzing its causes,this paper draws research conclusions and explores the processing mode of civil subject qualification confirmation,strengthen awareness of legal right protection.For e-commerce and consumers,widely used in quick cutting procedures Establish electronic contract and electronic seal method application ledger,establish online complaint center and online dispute settlement mechanism,establishment of e-commerce reserve and bank advance compensation system,improve the development of judicial service e-commerce,the establishment of judicial government linkage optimization enterprise business environment system specific recommendations.It is expected to promote the judicial settlement of agricultural products e-commerce marketing disputes,consolidate the achievements of poverty alleviation and rural revitalization.
