| With the development of the information age,the requirements for the dissemination of information have not only stayed in the speed era and the number of winning,with rapid development of social media information,to protect information and to be required for the information,It has become an important subject of information dissemination in the era of social media.Compared with the false information transmitted by traditional media,the harmfulness of false information in social media is that the concealment of false information in social media is stronger,it is difficult to find the source of false information,and the negative influence is difficult to be eliminated.At present,in the legal governance of social media false information in China,there are some drawbacks,such as incomplete legal norm system and imperfect law enforcement mechanism,so it is very urgent to perfect the legal governance of social media false information.This paper expounds the basic concept of social media false information,combs the corresponding characteristics of false information in social media and the necessity of governance,and analyzes the shortcomings of the legal governance of social media false information in China.This paper analyzes and draws lessons from the legal governance of foreign social media false information,and puts forward reasonable suggestions for the legal governance of social media false information in China.This paper is divided into five parts: the first part introduces the research background and sketches out the research significance of the legal governance to social media false information dissemination on the legal perspective of communication related knowledge.The second part discusses the legal concept of social media false information,the jurisprudence analysis of false information governance and the practical necessity of social media false information legal governance.The third part focuses on the current legal system,legal regulation,legal relationship,legal system and so on of social media false information in China.Chapter four focuses on the legal governance of false information in foreign social media,which is divided into Mainland law system and European and American law system.The fifth part puts forward some suggestions on the problems existing in the legal governance of social media false information in China,and discusses the inevitable path of perfecting the legal governance of social media false information from the aspects of prior examination,supervision in the event and regulation after the event.It is redized to stabilize the order of social media communication,guide the public correctly,maintain social stability. |
