Research On Problems And Optimization Of "Contract Execution" Index In China’s Business Environment Assessment

At present,business environment has become the focus of legal and economic circles,which includes the entire process from establishment to bankruptcy of an enterprise,especially the impact of the external environment on its production and operation.A business environment is as important to a company’s production and operation as air,water and food are to people.Without a sound business environment,a company is like water without a source or a tree without roots,which is not conducive to its development.Xi general secretary for many times in international conference pointed out that "the rule of law is one of the best business environment" good only by means of the rule of law,to create high quality,high standard for the enterprise,a high level of business environment,under the rule of law business environment including legislation,law enforcement,judicial,law-abiding,four aspects,at present in three ways to make good progress,and in the judicial aspect still has room for improvement.As an important part of the rule of law,the judiciary plays a central role in creating a high-quality business environment.Today,the judiciary has become one of the main factors in creating a high-quality business environment.The International Finance Corporation(IFC),a subsidiary of the World Bank,took 190 economies as samples,took 10 indicators related to the quality of the business environment as evaluation criteria,and issued questionnaires as evaluation methods to evaluate the business environment of smes around the world.Among the above ten indicators,the evaluation of the judicial environment of enterprises in the process of production and operation includes "protection of small and medium investors","contract execution" and "bankruptcy handling",among which the "contract execution" indicator reflects the efficiency of contract execution and is the "court competitiveness" indicator.To optimize execution contract index,to optimize the corresponding rules of judicial system,this article mainly business environment assessment "contract execution" index as the breakthrough point,from the world bank in our country the index scores derived problem,analyzing the shortage of the lawsuit system in our country as the business environment to provide security and improvement suggestion,thesis is divided into four parts:The first part,the implementation of contract indicators overview.This part includes three aspects: methodology,index composition and essence of the contract execution index.The purpose is to interpret the contract execution index from all aspects and lay a foundation for subsequent research.The second part is the analysis of the current situation of the contract index of China’s business environment assessment.On the one hand,the analysis of the status quo of contract execution in China’s contract execution index in the World Bank’s business environment report and imitation of the World Bank’s time index in part of the relevant population in the form of questionnaire survey results are analyzed.On the other hand,the time index,the cost index,the quality and efficiency of judicial procedures reflect the shortcomings of China’s relevant litigation system and related legislation.The third part,the experience and reference of improving the implementation of contract indicators outside China.It provides a reference scheme for the overall improvement of "contract execution" index in China’s business environment assessment.The fourth part,the business environment evaluation of our country executes the contract index optimization countermeasure.It is divided into three parts.First,corresponding countermeasures are put forward for the optimization of time indicators,and optimization countermeasures are put forward in the three aspects of service link,examination and supervision,and execution time.Second,for the problems reflected in the cost index,for the existing litigation cost payment system and appraisal cost supervision put forward optimization countermeasures.Thirdly,for the problems existing in the quality of judicial procedure,optimization countermeasures are proposed from the aspects of postponing court session and electronic litigation.
