Abstract/Summary:
The marriage legal system of the Jin Dynasty is not only an important part of the legal system of the Jin Dynasty,but also an important part of the minority marriage legal system in ancient China,and a bright pearl of the marriage legal system in ancient China.Marriage in ancient China had the purpose of continuing the clan and sacrificing the ancestors,which decided that the construction of marriage law was to maintain the family and ruling order,that is,family-centered rather than individual will-centered,and the same was true of the construction of the marriage legal system of the Jin Dynasty.For example,the succession marriage before the establishment of the Jin was to prevent the outflow of family property,the world marriage system after the establishment of the Jin was to maintain the needs of the feudal rule of the Jin Dynasty,and the rulers in the middle and later period of the Jin accepted the ethnic marriage and the study of Confucianism to better consolidate their rule.None of these has a personal will.The main contents of this paper are divided into the following five parts: the first part,the social background,the marriage legal system,the marriage and divorce of the second part,the second part,the applicable conditions and exception rules,and the third part,the change of women in economy and politics.In short,the marriage legal system of the Jin Dynasty not only has its own characteristics of the own nation,but also has the general characteristics of the marriage legal system of the Central Plains.By exploring the emergence and development of the marriage legal system in the Jin Dynasty,we can view the marriage system of ethnic minorities in China with a more inclusive attitude,which is more conducive to understanding and implementing the regional ethnic autonomy system in China and the handling of ethnic minority marriage problems.
