| With the changing of the Internet technology,makes the people to every corner of social life spewing out efficient processing of all kinds of information,personal information for the market,on the importance of the government and the society has been reflected,but it also brings new problems and challenges,the ubiquitous personal information collection analysis not only violated the dignity and freedom of information subjects,It also often leads to security events that compromise the information subject.It can also be seen from some problems in this field that the traditional personal information protection mode no longer seems to adapt to the new social reality,and we urgently need a strict personal information protection system.With the introduction of the Personal Information Protection Law,China has a systematic,authoritative personal information legal norms,but there are still a lot of worthy of discussion,this paper first through the analysis of the concept of personal information,clear the definition of personal information and the specific scope of the coverage.From the theoretical analysis and induction of academic disputes and arguments,it is concluded that personal information is a specific personality right with personality attributes and economic attributes.Secondly,through the analysis of the specific problems existing in the process of judicial practice,the difficulties and complexity of personal information protection in China are clarified.Finally,this paper based on the current system still need to strengthen the position of the personal information protection,combining with the experience of extraterritorial law,namely the privacy protection system and industry self-discipline system in the United States,the European transparency principle,in the general data protection ordinance informed consent rules,to set up the system of right to be forgotten,for personal information protection system in China was put forward,It mainly includes perfecting the obligations of information processors in legal provisions,adopting typed definition of personal information,establishing specialized information processing institutions and establishing perfect data disclosure notification system. |
