Study On The Protection Of Male Marriage Rights And Interests In Ethnic Areas ——Taking 100 Cases As Analysis Samples

With the development of reform and opening up and the development of the migrant economy,as well as the emergence of the unbalanced ratio of males and females across the country,female resources have migrated in a cascade,and the problem of male marriage squeeze has become more and more prominent,especially in ethnic minority rural areas.Marriage squeeze has made it difficult for men in ethnic areas to marry,to keep marriage after marriage,and to remarry after divorce,causing many problems in marriage and family,while the issue of marriage rights and interests of rural men in ethnic areas has not received enough attention.There is a certain conflict between the customary marriage law in ethnic areas and the national legislation,and rural men in ethnic areas have not been effectively protected after their rights and interests have been damaged in marriage disputes.When rights are not effectively relieved,it will lead to a series of adverse consequences,affecting the stability of marriage,rural revitalization and social development in ethnic areas.This paper takes the marital disputes of rural men in ethnic areas as the research object,focuses on the protection of rural men’s rights and interests in ethnic areas,and takes 100 cases of rural men’s marital rights damage in ethnic areas from China Judgment Document Network as the analysis samples,and takes judicial application as the analysis sample.The foothold of the research is to carry out in-depth research on the protection of marriage rights and interests of rural men in ethnic areas in the tension between concepts,laws and cases.Status quo,analyze the reasons for the formation of the status quo,focus on solving the problem of conflict adjustment between marriage habits in ethnic areas and national laws and the problem of rural male marriage squeeze in ethnic areas,and try to propose corresponding rights relief methods to protect the rights and interests of rural male marriage in ethnic areas.The full text consists of introduction,conclusion and four chapters.The first chapter tries to excavate the theoretical basis of the protection of men’s marriage rights and interests from the equal rights theory of equality between men and women,and analyzes the institutional basis of the protection of men’s marriage rights and interests from the historical changes of my country’s marriage system.The second chapter summarizes the types of rights and interests of rural men in ethnic areas by sorting out 100 case samples,analyzes and summarizes the characteristics of rights and interests damage and the negative impact,and points out the actual state of rights and interests damage.The third chapter analyzes the reasons for the damage to the rights and interests of rural men in ethnic areas from the aspects of the rule of law,society and values.The fourth chapter discusses the ways to solve the protection of marriage rights and interests of rural men in ethnic areas from the aspects of the rule of law,society and values.
