In the process of social development,in order to improve life and develop production,it is a very common means for human beings to introduce species from other regions to their native land.As early as BC,our country introduced grapes and pomegranates with sour and sweet taste.With the deepening of human understanding of the world,begin to pay more attention to the importance of the natural environment.How to deal with the relationship between good people and ecology has become a difficult problem for the whole society.Although the introduction of alien species has its irreplaceable advantages,such as improving people's lives,bringing local economic benefits and enriching species diversity,the introduction of unsuccessful species will cause irreparable damage to natural ecology,human health and production development.Nowadays,alien species invasion has become the second largest ecological crisis after habitat destruction,and many foreign countries are suffering from this problem.However,China's attention to the invasion of alien species started late,and the possible damage to intentional introduction has attracted wide attention in recent years.The legal system of alien species in China is scarce,the technology is backward,and the management of alien species is loose and chaotic.Not only the risk assessment and licensing system before introduction is not perfect,the inspection and quarantine system in the process of introduction is not perfect,but also the necessary monitoring and early warning measures after species introduction,which will undoubtedly become a major hidden danger affecting the ecological security of our country.Contradiction is the motive force of the development of things,and any contradiction has its universality and particularity.Therefore,we should grasp the main contradiction of the invasion of alien species,analyze the deficiency of the intentional introduction process,and put forward the solution to the problem on the basis of the actual situation of the country and draw lessons from the existing experience in the prevention and control of alien invasion.The first part is an overview of alien species invasion.This part introduces the concepts of intentional introduction,alien species and alien species invasion,and focuses on distinguishing the understanding of the concept of "introduction ",that is,it is human behavior and needs to be regulated.This part also introduces the purpose of intentional introduction of alien species in China,the potential harm of intentional introduction and the classification of introduction.The second part is the analysis of the current situation and problems of the introduction of legal regulation of alien species in China.This part analyzes the legal problems that our country intends to introduce from three aspects,including the national legal level,the local legal level,and the management system.The third part is the experience of introducing legal regulation to alien species.In this part,from the international and three typical countries of alien species invasion related legal regulation analysis,listed the existing international legal principles,legal documents,the United States,Japan,New Zealand management system,legal system,In order to provide reference for China's intentional introduction of legal regulation.The fourth part is the suggestion to perfect the legal regulation of alien species in China.This part is divided into management system and legal system,combined with foreign experience and the background of the introduction of China's Biosafety Law,put forward a vision of the management system of alien species;in the legal system,it is proposed to improve the system of intentional introduction of licensing,risk assessment,alien species directory system,monitoring and early warning system.
