Research On Local Legislation For The Protection Of Ancient Buildings In Jianshui, Yunnan

The ancient buildings of Jianshui in Yunnan Province represent the culture and history of Jianshui,reflecting people’s production and life,social development,cognitive level,way of thinking and values at that time.They have important artistic value,scientific value and historical value.There are many ancient buildings in Jianshui.Since the concept of ancient city protection was first put forward,people have ignored the protection value of ancient buildings in it.There are few researches on the local legislation of ancient buildings in the current research.More researches focus on the maintenance of ancient buildings and the development history of ancient buildings,ignoring the legislative protection.First of all,there is no unified standard for the legal definition of ancient buildings.The existing protection content of ancient buildings is at most reflected in the famous city protection regulations,but the concept is not unified,mostly the expression of "historical buildings","style buildings" and so on,which is different from the concept of ancient buildings in this paper.Secondly,the legislation does not extend the connotation of the protection of ancient buildings.Both the criminal law and the constitution do not pay attention to the legal protection of ancient buildings,which leads to the low level of the local legislation for the protection of ancient buildings.Finally,the legislative protection of ancient buildings actually refers to the provisions of cultural relics protection and famous historical and cultural cities,and the legislative protection basis of ancient buildings in this paper is also taken from them.No matter Yunnan Province or Honghe Prefecture(to which Jianshui County belongs),there is no special legislation on ancient architecture.Huangshan City has special regulations for the protection of ancient buildings,both the definition of the concept of ancient buildings and the overall protection system are relatively perfect.This paper focuses on the reference of Huangshan City on the basis of local legislation of ancient buildings,and puts forward relevant suggestions for the protection of local legislation of ancient buildings in Jianshui.The main body of this paper is to discuss the necessity of local legislation protection of ancient buildings through the study of the problems existing in the protection of ancient buildings in Jianshui.Specific research contents include: the definition of ancient buildings,ancient buildings built water distribution,and built the ancient buildings protection present situation,the existing laws and regulations),analysis of ancient buildings built water existing problems at present stage,through the analysis of the legislation to protect ancient buildings at home and abroad,and then to the historical and cultural city protection industry in jianshui ordinance as a starting point,analysis of ancient buildings in the absence of legal protection,finally aimed at these deficiencies,perfect Suggestions are put forward.
