A Brief Analysis Of The Living Space Of Non-blood-related Family Members In The Clan Society During The Qian-Jia Period

Abstract/Summary:
There are four kinds of non-blooded family members,the heir,the righteous son,the stepmother and the son who remarried with his mother.They join into the present family by means of succession,adoption,remarriage,remarriage with their mother and so on.they have no direct blood relationship with the current family members,or even have no blood relationship at all,so they are called non-blood family members.The study of family status,clan status,legal status and even living space of non-blood-related family members is of great academic value to the study of family relationship and clan society in Qing Dynasty,and it is helpful to deepen the understanding of social and legal history in Qing Dynasty.According to the differences of non-blood relation members,the paper is divided into four chapters.Each chapter specially analyzes the differences between non-blood-related family members and blood-related family members from three aspects of family status,clan status and legal status in order to analyze the living space of non-blood relation members in Qianjia period.The first chapter is about the living space of heir in Qianjia period.heirs are parents who have no son-in-law with in the clan who have succeeded the nephew of equal rankof the inheritance of the important responsibility for the continuation of fireworks.so the heir and father have a certain blood relaionship,which is also the difference between the heirs and other non-blood family members.It is necessary to establish a succession document,so the parent-child relationship between the heir and the heir is recognized by law.However,the relationship between the heir and the heir parent is more fragile than that of the biological child,and the heir parent has the right to dissolve the parent-child relationship at any time.The second chapter discusses the living space of the foster son.There are many restrictions on the adoption of righteous children in the past dynasties,and it is considered improper to adopt different surnames.But in the Qianjia period,under the action of population explosion,war,famine and other factors,the adoption of foster son is quite common.The law no longer strictly forbids the upbringing of children with different surnames,but firmly does not allow them to be heirs.Because the foster son was raised from an early age,the relationship between foster son and parents is profound,and the foster son has a high family status.However,due to the lack of recognition by law,the legal status of the foster son can not be protected,which just equivalent to employed workers.The third chapter analyzes the living space of stepmother.The recognition of stepmother status has been established in the pre-Qin period,and the Confucian doctrine of "stepmother as mother" has not changed much in the past dynasties,as has the Qianjia period.So in the Qing Qianjia period,the stepmother has a higher living space,but compared with the mother,there are still some small gaps.The fourth chapter discusses the living space of children who remarried with his mother.The relationship between the son remarried with his mother and his stepfather is the most loose pair in the non-blood family relationship.They are only temporary cohabitation,far from reaching the height of "father and son",so the relation between the son remarried with his mother and his stepfather is not close.In law,the relationship between the two is more equal,do not have to be punished according to the Five blood relatives system,different from the other three pairs of relationship.The last part of the conclusion is an overview and summary of the living space of non-blooded family members in Qianjia period of Qing Dynasty.Through the above research and analysis,I think there is a huge gap between the living space of non-blooded family members in Qianjia period and the consanguineous family members.Even the legally recognized heir and stepmother can not obtain the same living space as bilogical son and bilogical mother.
