Research On The Online Resolution Mechanism Of E-commerce Disputes In My Country

The emergence and development of e-commerce,a new business model,not only subverts the traditional business model,but also puts forward new requirements on how to solve e-commerce disputes effectively.The traditional dispute resolution mechanism has many disadvantages,such as unclear jurisdiction,long litigation cycle and high litigation cost,which restrict the efficient settlement of e-commerce disputes.After years of practice,developed e-commerce countries and regions in Europe and America have established a mature ODR mechanism to solve e-commerce disputes.Some e-commerce platforms,professional ODR platforms,arbitration organizations and judicial organs in China have already begun to explore online solutions to e-commerce disputes,and have initially formed a multi-type ODR layout.However,the legal status of the ODR is still unclear,except for some forms,it is basically in a state of autonomy.Based on the analysis of current situation of the development of e-commerce online dispute solution mechanism in our country,on the basis of analysis on the mechanism of the existing legislation,inadequate protection of the program and the auxiliary mechanism imperfect,and combined with its practical situation,puts forward to perfect the ODR legislation,standardize the ODR procedural rules,and improve the mechanism of the ODR auxiliary,such as specific Suggestions,in order to perfect our country electronic commerce online dispute settlement mechanism.
