Research On Investigation And Evidence Collection Of Underworld Organized Crime

Underworld forces are cancers that endanger society,and the people hate them deeply.In early 2018,the Central Committee of the Communist Party of China and the State Council issued the "Notice on Launching a Special Struggle to Suppress Mafia and Evil",and decided to launch a special campaign against gangs and evils across the country.After three years of hard work,the national campaign against gangsters and evil has achieved a comprehensive victory.However,there is a long way to go to normalize the eradication of gangsters and evils,especially organized crime of underworld nature.Because of its huge social harm,it not only brings a great sense of insecurity to the people,but even endangers the political,economic and social stability of one party.At the same time,with the continuous advancement of my country’s efforts to eradicate gangsters and evil,the criminal activities of gangster organizations are also undergoing changes.Crime venues turn to the internet and more.In the process of investigation and evidence collection,due to the lack of investigative thinking of case investigators,there are shortcomings in evidence collection and evidence thinking,which seriously affects the effectiveness of case handling.How to deal with and solve these problems,improve the work level of detecting underworld organized crime cases,and ensure the work effect of detecting underworld organized crime cases is an issue that must be highly valued at present and in the future.With the promulgation of the "Anti-Organized Crime Law" at the legislative level,it has provided legal support for my country’s fight against underworld organized crime,and it also reflects the attitude of severely cracking down on underworld organized crime at the national level.Under this background,it is undoubtedly of positive practical significance and profound academic significance to propose and study the investigation and evidence collection of organized crime of underworld nature.There are three main parts in this thesis.The first chapter sorts out the identification of "four characteristics" in domestic laws,regulations,meeting minutes and guiding opinions about underworld organizations,analyzes and compares the evil forces similar to underworld organizations and their connection with organized crime.Through the cases published by CNKI,the Ministry of Public Security and the Judgment Document Network,this thesis summarizes the characteristics and development trends of criminal cases of underworld organizations.The development of society has promoted the legislation of organized crime of underworld property,and the development of organized crime of underworld property is also affecting the changes of law,thus affecting the evidence collection standard for this kind of crime.The second part analyzes the difficult points of obtaining evidence of organized crime cases of gangland nature.This thesis mainly expounds the difficulties of obtaining evidence in the process of investigation from five aspects.By mastering the documents issued by the Ministry of Public Security,analyzing the cases of the judgment document network and learning the knowledge of thesiss,this thesis analyzes the dilemma of obtaining evidence in practice from the perspectives of evidence collection thinking,obtaining evidence,investigation interrogation,additional arrest and investigation cooperation.The third chapter proposes countermeasures for the above-mentioned difficulties in obtaining evidence,which is also the focus of this thesis.First of all,the investigators must ideologically establish the concept of collecting evidence under the guidance of laws and regulations,and support the comprehensive development of the evidence collection work from the three aspects of organization,system and material.Use information technology to research and judge clues to capture the signs of underworld organized crimes;use blockchain technology to help forensics work,through the establishment of databases,and innovate data collection methods;due to the characteristics of underworld crimes,people testify and report The awareness is not high,so it is necessary to encourage the masses to actively cooperate with the public security organs and report relevant criminal clues;the characteristics of underworld organized crimes determine the importance of verbal evidence in detecting such cases,and investigators choose breakthroughs and formulate reasonable interrogation strategies to ensure that The interrogation work was carried out smoothly.In addition,we will improve cross-regional and cross-international cooperation in arresting,jointly discuss effective arrest strategies,and promptly arrest and bring criminals who have committed crimes in different places and escaped to justice.Pay attention to collaboration with other industry regulatory agencies,organize specialized agencies,establish expert databases,strengthen position control,and with the assistance of multiple departments,eliminate all investigation resistance,and make every effort to promote evidence collection.
