The ocean is rich in biological resources and contains great energy and value.Countries are keen to exploit and exploit biological resources in waters beyond their national jurisdiction,thus destroying ecosystems and causing disputes among them.As a result,the protection of biodiversity in waters beyond national jurisdiction has become a key issue of common concern to the international community.Countries agreed to form a legally binding international agreement on the conservation and sustainable use of biodiversity in areas outside national jurisdiction(BBNJ)and began lengthy negotiations.Based on the analysis and research of the legal problems existing in BBNJ protocol,this paper is divided into four parts.First of all,the overview of the negotiation on marine biodiversity beyond national jurisdiction mainly introduces the basic concept of biodiversity,and the value meaning leads to the origin and process of the negotiation of the BBNJ international agreement.Secondly,the current status of legislation on marine biodiversity beyond national jurisdiction analyzes the existing relevant legal norms and their shortcomings.Third,the disputed issues in the negotiation of marine biodiversity beyond national jurisdiction mainly include the discussion of the four issues in the package plan and the opinions of various countries.Finally,in the recommendations and countermeasures for the negotiation of marine biodiversity beyond national jurisdiction,the feasible recommendations for the negotiation of the BBNJ international agreement include the establishment of a benefit sharing system for marine genetic resources,the establishment of a fair and reasonable environmental impact assessment system,and the establishment of a global model Zone management tools and balance capacity building and technology transfer.It also puts forward the countermeasures China should take in the negotiation,such as perfecting and perfecting the corresponding domestic legislation,promoting the development of my country's marine scientific research technology,and strengthening cooperation with other subjects.
