Research On Legal Risk Countermeasures Of Chinese Enterprises' Overseas Contracting Projects

Since the "one belt,one road" initiative was proposed,China's enterprises have been actively responding to national policies.China's one belt,one road project,however,suffers from losses.Under the dual factors of external nationalization risk and internal lack of compliance,the defects of Chinese enterprises' legal participation in trade under the traditional thinking are gradually emerging.Based on the research on the legal risk countermeasures of Chinese enterprises' overseas project contracting,this paper first clarifies what is legal risk,and explains why enterprises should pay attention to the prevention of legal risk through real data statistics;secondly,it analyzes typical cases,and summarizes the bidding,contract signing,construction stage and dispute resolution of enterprises' overseas project contracting according to different stages of enterprises' overseas project contracting Finally,it puts forward the Countermeasures for the common legal risks.The state should change the guiding ideology of foreign legislation,timely revise the bit agreement with other countries,improve the insurance system of foreign contracted projects,innovate the dispute settlement mechanism,ensure fair competition in the market and cultivate professional talents;enterprises should pay attention to investigation and preparation in the bidding stage,strengthen contract management in the contract signing stage,and cooperate with enterprises in the host country in the construction stage And using the existing dispute settlement mechanism to safeguard their own rights and interests.
