Research On Comprehensive Law Enforcement Mode Of Tourism

Tourism is a highly comprehensive industry,covering catering,housing traveling,tourism,shopping,housing,entertainment experience,meeting,health,preservation,media,organization,form a complete set and many other fields,tourism market order supervision involves the tourism sector,the transport sector,the public security department,the market supervision department and other functional departments.For a long time,various kinds of tourism chaos occurred frequently,such as "unreasonable low price tour","forced shopping" and other illegal acts that seriously infringe on the legitimate rights and interests of tourists,while the phenomenon continues to persist.China's administrative law enforcement system is based on the principle of specialization,the law enforcement authority of each department is limited to the scope of responsibility of the department.The comprehensive administrative law enforcement of tourism industry with strong comprehensive,tourism department law enforcement alone is difficult to effectively combat illegal activities in the tourism market.At present,there are some problems in tourism related departments,such as overlapping responsibilities and multiple law enforcement.In order to solve this problem,local governments have formulated different comprehensive law enforcement models of tourism,including large department law enforcement mode,joint law enforcement model,relatively centralized punishment power model and law enforcement mode of scenic spot management committee.From the perspective of law enforcement effect,the comprehensive law enforcement model of tourism solves the problems of cross law enforcement and limited scope of authority of departments to some extent.However,from the perspective of the current situation of the tourism market,the law enforcement effect of the current tourism comprehensive law enforcement mode is not good,the main reasons include the inconsistency of legal norms and standards,the lack of institutional guarantee,the weak mechanism construction,etc.This is also the current tourism comprehensive law enforcement model is difficult to effectively curb the illegal and chaotic problems in the tourism market.In order to solve this problem,firstly,this paper summarizes and studies the current comprehensive law enforcement mode of tourism through case analysis;secondly,SWOT analysis method is used to analyze the comprehensive law enforcement model of tourism,through the analysis of its strength,weakness,opportunity and threat,it is found that the application of different tourism comprehensive law enforcement modes is different and have achieved certain results.While different tourism comprehensive law enforcement models all have some normative and operational problems,such as uncoordinated legal norms,lack of stability of mechanism and imperfect coordination mechanism.In view of this situation,this paper analyzes the strength,opportunity,weakness and threat of the tourism comprehensive law enforcement mode,to solve these common problems,to promote the rule of law from the aspects of perfecting the coordination of legal norms,strengthening the scientific design of the system,enhancing the effectiveness of the administrative law enforcement system,and establishing and perfecting the coordination mechanism of law enforcement,it is expected to provide a useful reference for the improvement of tourism comprehensive law enforcement model.
