This article studies the question: in the context of the new era of diversified social development,what is the relationship between public opinion and judicial judgment,and how should it be adjusted? Today's China is undergoing a stage of judicial system reform.The public's awareness of the rule of law is constantly improving,and they are paying more and more attention to hot cases in society,which has gathered strong public opinion,prompting the judiciary to begin to consciously pay attention to and listen to the public opinion.However,the current situation in our country makes it impossible for the judiciary to meet the interests of every class in the society at the same time.The conflict between public opinion and judicial decisions cannot be ignored.Now is the key point in the development and evolution of China's criminal justice.In view of the contradiction between public opinion and judicial adjudication,the game between jurisprudence and favor can go deep into the details of the institutional structure to coordinate the relationship between the two.The purpose of this article is to analyze the causes and impacts of the conflict between public opinion and judicial judgment,and then propose suggestions for coordinating public opinion and judicial judgment.The article is mainly divided into five parts:The first part starts with three typical cases,analyzes the cases,and summarizes the common problems reflected in the cases,that is,the conflict between public opinion and judicial judgment.The second part analyzes and demonstrates the internal reasons for the conflict between public opinion and judicial judgment from several aspects.The reasons for the conflict between public opinion and justice mainly include the difference between public opinion and justice pursued by justice,and there are certain problems in justice.News The media's untrue reports and the public's hatred of the rich.The third part,after analyzing the reasons for the conflict between public opinion and judicial judgment,discusses the impact of public opinion and judicial conflict,including positive and negative impacts.Positive influences include raising public awareness of the rule of law and supervising justice;negative influences include damaging judicial authority,weakening judicial credibility,and blurring the boundaries between law and morality.The fourth part analyzes the necessity of adjusting public opinion and judicial judgment.Mainly from the two aspects of enhancing the acceptability of judicial judgments and the public's supervision of judicial power.The fifth part puts forward some suggestions on adjusting public opinion and judicial judgment in response to the problem.The first is the judicial field,including the implementation of the people's jury system,and accelerating the substantive process of court trials;the second is the media field,which mainly includes standardizing media reports and strengthening media responsibilities;and finally,the social public field,which raises the public's awareness of the rule of law and accepts new values.Express public opinion rationally.
