The countries in the Northeast Asian region,which are adjacent to many oceans,are facing a series of problems caused by marine pollution.Pollution in one country not only harms the development of its own marine economy,but also brings unmanageable effects to neighboring countries.If we do not pay attention to marine environmental protection and sustainable development of resources,and ignore the control of marine pollution for the sake of economic benefits or transferring risks,it will cause the pollutants entering one sea area to migrate to another sea area,and it will be difficult to transfer them out again.Therefore,marine pollution in Northeast Asia is a matter of concern for the development and health of the people in neighboring countries.Environmental cooperation in Northeast Asia has been developed over the years and has achieved some success.However,there are still many issues that need to be considered in order to further deepen the cooperation on marine environment in Northeast Asia.From the perspective of international law,the environmental problems faced by the coastal countries in Northeast Asia should not be underestimated.In the international community,many effective systems of cooperation in the protection of specific sea areas have been established with regard to the governance model of trans boundary marine pollution.The United Nations Environment Programme(UNEP)has used the successful experience of the European region as a template to promote marine projects in other parts of the world,and many scholars have promoted this regional convention model in their studies.In particular,the general provisions of global conventions and agreements and the specificity of bilateral agreements cannot be well applied to the cooperation of the whole region,while the beneficial experience of cooperation between developed and socialist countries in the Mediterranean region coexisting and the Baltic Sea apolitically complex,and the Northeast Asian region with a high degree of similarity,has profound implications for Northeast Asian marine trans boundary pollution cooperation.Although environmental cooperation in Northeast Asia,including marine pollution,has been developed for many years,it is still in its infancy compared to the cooperation in the Baltic Sea and the Mediterranean Sea,and most of the meetings related to marine cooperation are only about information exchange on the pollution status of each country,and the meetings held once a year are mainly for discussion.The various forms of international cooperation have had little effect due to the political and economic differences between countries.On April 13,2021,the Japanese government decided to dispose of nuclear wastewater from the Fukuyama nuclear power plant accident by ocean discharge.The seriousness of the seawater pollution problem will be shown to the international public again.Whether such a practice of Japan is in accordance with international law and whether the trans boundary marine pollution cooperation prevention and control in Northeast Asia is binding for this act of Japan are questions that we need to discuss urgently.This paper will explore the limitations and possibilities of international law in terms of legislation and policy theory in order to solve the problems of China and Japan in Northeast Asia in light of the above-mentioned development of international law,focusing on trans boundary environmental issues that have attracted more and more attention in recent years.
