Research On Legal Issues Of Traceability Supervision Of Chinese Herbal Medicines In My Country

In recent years,people's demand for health is gradually diversified.They pay more attention to reducing side effects of drug use,pay more attention to sub-health conditioning in addition to curing diseases,and the concept of treating diseases is deeply rooted in people's minds.Therefore,traditional medicine once again ushered in the development tide.Traditional Chinese medicine(TCM)is a precious cultural heritage of the Chinese nation.It plays an important role in maintaining people's health,preventing and curing diseases.At the same time,as an economic resource with unlimited social potential in China,TCM industry has also encountered some problems in the development process.The ecological environment of Chinese herbal medicine planting,seed selection and cultivation,pesticide use and breeding management,as well as the collection,processing and transportation,storage and the final use of Chinese herbal medicine all face a variety of safety challenges.The traceability system of Chinese medicinal materials can not only record the data information of TCM decoction pieces,such as feeding,testing and packaging,but also record the origin environment,growth process,and subsequent processing and preparation of the original medicinal materials.The traceability system of Chinese medicinal materials utilizes the Internet of Things,block chain and other advanced information technology means to achieve the purpose of traceability and supervision of Chinese medicinal materials throughout the whole process by recording the information of each link of Chinese medicinal materials and subsequent identification and inquiry.The Chinese herbal medicine quality traceability system can not only ensure the safety of Chinese herbal medicine products,but also realize rapid and accurate recall when defective products are found.Based on the characteristics of Chinese medicinal materials,this paper sorted out the relevant laws and regulations of traceability of Chinese medicinal materials and combined with the implementation of various pilot projects in China,so as to find out the problems existing in the traceability supervision laws of Chinese medicinal materials and analyze their causes.Based agency under the State Council reform background,analysis of regulatory changes on the impact of Chinese traditional medicine regulation,from the perspective of administrative law analysis of Chinese medicinal materials traceability multisectoral regulatory authority allocation theory,traces the regulation at home and abroad for reference,the legal system,perfect the legislation system,unified regulator,play to the social supervision strength,improve the traceability standard,improve enterprise trace ability,Suggestions were put forward to further improve the traceability supervision of Chinese medicinal materials from the aspects of specific supervision object responsibility content,optimization of responsibility form,construction of information sharing platform,improvement of electronic supervision and so on.This paper is divided into four parts:The first part is the overview of traceability supervision of Chinese medicinal materials.The content includes relevant concepts of Chinese herbal medicines,traceability,definition of Chinese herbal medicine traceability system and the necessity of improving Chinese herbal medicine traceability supervision.The second part,the legal status and problems of traceability supervision of Chinese medicinal materials in China.The content includes the status quo of the traceability legal system of Chinese medicinal materials and the legal problems existing in the supervision practice.The third part is the extraterritorial research.It includes the retroactive legal systems of the European Union,the United States,Japan and South Korea and their experiences.The fourth part:Suggestions to improve the traceability and supervision of Chinese medicinal materials.The content includes four aspects:increasing legislative levels,refining legal provisions,clarifying regulatory powers,attaching importance to social participation,specific targets of responsibility,optimizing the form of responsibility,unifying traceability standards,and improving electronic supervision.Accurate definition of the concept is the premise of academic research.This paper first defines the concept of drugs,traditional Chinese medicine,Chinese medicinal materials,traceability,traceability system and traceability system of Chinese medicinal materials.At the same time,combining with the current development status of Chinese herbal medicine industry,the necessity of strengthening the traceability supervision of Chinese herbal medicine was explained in detail.Second,the discovery of problems must be based on a detailed understanding of the current status of the legal system.Therefore,the legal status quo of traceability supervision of Chinese medicinal materials was classified and sorted out,so as to find the problems existing in legislation,supervision subject,supervision content,supervision object and supporting system of traceability of Chinese medicinal materials in China.Thirdly,the experience of advanced countries outside the region is investigated in detail.Combined with China's specific national conditions and the characteristics of Chinese herbal medicine,the reference for Chinese herbal medicine traceability supervision is obtained.Finally,suggestions on traceability and supervision of Chinese medicinal materials in China were obtained through current situation review,problem analysis and experience reference from outside the region.The conclusion of this paper plays a positive role in promoting the supervision of traceability of Chinese medicinal materials,the construction of legal system and the protection of consumers' rights and interests.
