Research On Blockchain Financial Administrative Supervision System

In recent years,information technology has been continuously innovated,especially the emerging financial technology(Fintech),which is a combination of Internet information technology and finance.The corresponding risk issues have brought shocks and new challenges to the traditional financial administrative supervision system.Blockchain,as a new technology in Fintech,is one of the core issues that should be studied because of its effective regulatory issues arising from its widespread use in the financial sector.This paper expounds the concept and characteristics of blockchain,the innovative application in the financial field and the status of domestic and international administrative supervision of blockchain finance,and puts forward some suggestions for improving the administrative supervision mode of blockchain finance.This paper mainly consists of six parts:The introduction.This part expounds the origin of this paper,the research status and significance at home and abroad,and the research methods adopted in this paper.The first chapter is the historical development and theoretical basis of blockchain financial administrative supervision.This paper introduces the connotation of blockchain technology,the development status,feasibility and importance of blockchain finance,the necessity of blockchain financial administrative supervision and the theoretical basis of blockchain financial administrative supervision.The second chapter is the status quo and existing legal problems of blockchain financial administrative supervision in China.At present,China's administrative supervision of blockchain finance adopts the passive supervision mode of "development first,planning later" under the framework of separate supervision,and adopts the "one size fits all" supervision for virtual currencies with significant risks and initial issue of tokens(ICO).There are some legal problems,such as the lag of laws and regulations,the impotence of the subject of administrative supervision and the vagueness of the object of administrative supervision.The third chapter draws on the financial administrative supervision system of extra-territorial blockchain.Foreign frontier regulatory status of block chain financial analysis,to distinguish between different countries block chain finance related supervision system,summarizes the foreign block chain financial supervision system of our country experience lesson,and then introduce new regulation pattern,clear administrative supervision legal relation subject and block chain financial regulation system of laws and regulations.The fourth chapter is to improve the institutional framework of blockchain financial administrative supervision in China.First,China should explore new regulatory models including functional regulation,regulatory sandbox,and regulatory technology.Secondly,complete the blockchain financial administrative supervision system,including defining the subject and object of blockchain financial administrative supervision,constructing the blockchain financial administrative special permission and administrative punishment system,and formulating the blockchain financial administrative supervision procedures.Finally,proposed the block chain financial administrative supervision legislation proposal.Conclusion.This part of the full text of the views of a brief comb and summary.Effective supervision of blockchain finance has become an important and urgent task facing China.In view of the main application mode of blockchain finance in China at present,the legal problems faced by the development of existing blockchain finance are sorted out,and the innovative supervision system of blockchain finance in foreign countries is used for reference to improve the administrative supervision system of blockchain finance in China.
