There are always great disputes about Marxist philosophy of law,including the young Marxist philosophy of law.With the development and maturity of Marx's thought,does Marx's philosophy of right still exist in Marxist philosophy? The negative answer to it is actually the cover to the development of Marx's philosophy of right.This paper focuses on young Marx's Critique of Hegel's Philosophy of Right,and makes a detailed study of young Marx's philosophy of right.In the face of the theoretical dilemma of modern natural philosophy of right and the vexed problems during Rhine newspaper period,young Marx began to criticize Hegel's philosophy of right in his reflection on the history of the French Revolution.His philosophy of right in this period consists of two parts: one is the criticism of Hegel's metaphysics;the other is the elaboration of the relationship between civil society and political state.Finally,Marx draws the conclusion that civil society decides the political state,that is,the material interest relationship determines the state and law.Therefore,the paper determines the philosophy of right thought of young Marx based on the relationship of material interests and the core value of "people's nature",thus turning the research direction of right philosophy to the civil society.Theoretically,the Marxist philosophy of right in this period outlines the outline of Marxist philosophy of right based on historical materialism on the one hand,and on the other hand,it has important significance for the traditional metaphysical right philosophy.In practice,it also has an important enlightenment on the construction of socialist rule of law and the thinking of our country's rights system.
