As a representative industry in the economic field of the Internet platform,the emergence of online car-hailing has not only met the travel needs of passengers,but also greatly improved travel efficiency.However,during its development,industry monopoly problems have gradually emerged,especially the Internet led by Didi.Car-hailing companies,after experiencing the subsidy war in the early stages of development,the market scale expanded,and then they merged with other companies,the market influence gradually increased,but controversy also followed.A series of behaviors implemented by Didi for its development may be suspected of abusing its dominant market position.The merger with Kuaidi and Uber China also has procedural flaws.If not effectively regulated,it will easily damage orderly market competition and hinder the benign development of the industry.However,because Didi is an emerging platform company,its monopolistic behavior is more complicated than the real economy,and it is difficult to identify.In view of this,many scholars and agency law enforcement officers are constantly exploring and trying to perfect the current anti-monopoly law from the theoretical level.At the same time,from a practical level to effectively regulate the monopoly of online car-hailing platforms.Therefore,this article mainly introduces the monopoly problem of the online car-hailing market and the current situation of legal regulations,summarizes its shortcomings,draws on the experience of outside the territory and combines my country's actual situation,and puts forward its own thinking on the anti-monopoly legal regulation in the field of online car-hailing platforms.This article progresses layer by layer from the theoretical basis,problem analysis and summary,introduction of extraterritorial legislation,etc.,and strives to put forward reasonable and effective perfect thinking and regulatory suggestions.At the level of theoretical overview,this article starts from the definition of online car-hailing and the characteristics of the industry,and introduces the theoretical basis and necessity of regulating it;in terms of problem analysis and summary,this article starts from the current status of monopoly and legal regulations in the online car-hailing market,Summarizing the existing problems of the current anti-monopoly laws and regulations,mainly including the definition of relevant markets,abuse of market dominance,and the review of concentration of undertakings;at the level of extraterritorial laws and regulations,this article mainly introduces the latest anti-monopoly laws in the United States,Germany,and other countries or regions.Monopoly legislation stipulates,combined with our country's actual narrative and enlightenment;finally,in view of the problems and deficiencies,we put forward the perfect thinking about the anti-monopoly law and regulation of China's online car-hailing market.Drawing on foreign experience,it is recommended to optimize the SSNIP method,the increase profit source definition method,etc.to determine the relevant market definition methods that adapt to the platform economy such as online car-hailing;it is recommended to increase the market share consideration factors,increase the importance of market behavior,and introduce the HHI index to optimize the method for determining market dominant position,and the role of the government should be used to regulate specific abuses;it is recommended to increase the probability of market share standards,establish a dynamic turnover adjustment mechanism to improve the standards for declaration of concentration of operators,and actively take measures to improve the review and enforcement of concentration of operators system.This article enriches the research on the legal regulation of the online car-hailing market,further discusses the monopoly issues of online car-hailing and other platform economies,proposes regulatory suggestions and measures,and improves the design of the anti-monopoly system from a theoretical level,hoping to be helpful to the practice of anti-monopoly law enforcement.
