Research On The Legal Regulation Problems Of Online Car-hailing Under The Background Of Sharing Economic

In recent years,with the help of Internet technology,China's sharing economy has made rapid progress and entered a burst stage,and various new forms of business have sprung up,showing a flourishing state.As the most prominent representative of the sharing economy,the online car-hailing services are developing rapidly.As a new way of travel,the online car-hailing services are fundamentally different from the traditional taxi services.It has relieved people's travel pressure,and has become an important supplementary part of public transportation with traditional taxi.With the development of the Internet,more and more young people are used to the way of transportation,but so many problems start to emerge,such as the problems of negative externalities,asymmetric information,and the problems of sharing economy itself.These problems and contradictions have forced people to reflect the necessity of regulate the online car-hailing services.Therefore,the first part of this paper elaborates the necessity of the regulation from the administrative law and economic law.China's online car-hailing services started relatively late,and it took shape in2014.The change and the impact of the online car-hailing services are big hit,hitting the traditional taxi industry,changing the way people travel,and even creating jobs.Of these numerous changes and influences,the most direct and most controversial is the government's regulation system of the online car-hailing.Indeed,the emergence of the online car-hailing service poses a great challenge to the regulation of the government.Therefore,after two years of observation and consideration of the ride-hailing service and the balance of interests of all parties,our government finally recognized the necessity of the regulation of the online car-hailing service,and issued“the interim measures for the management of online booking of taxi services”(referred to as the “interim measures”)in 2016.The “interim measures”,forthe first time,recognized the legality of the online car-hailing service,which is of great significance to the development of the online car-hailing service.At the same time,local governments,complying with the principles and principles of the central government,began to formulate detailed rules for the implementation of local ride-hailing vehicles,such as Beijing,Shanghai,Guangzhou and so on.So far,the legal regulation system and the framework of China's online car-hailing system have basically formed.But the current legal regulation of the online car-hailing service is not perfect enough,still exists various problems.The main problems are as follows.Firstly,The concept of regulation lags behind.The regulation of traditional taxi is adopted in the regulation of online car-hailing.And the regulation of online car-hailing do not conform to the idea of streamline administration and delegate power and sharing economy spirit.Second,the relevant legal provisions of the online car-hailing service are not reasonable.Thirdly,the current regulation system of the ride-hailing system also reveals that a big problem is heavy pre-regulation and light process regulation.In view of the problems in the regulation of China's online car-hailing system,based on the national conditions of China,i analyzes and studies the regulation system of online car-hailing in foreign countries,such as the United States,Singapore,Britain and France,to absorb excellent experience.Based on this,four countermeasures are put forward to improve the legal regulation of China's online car-hailing system under the background of sharing economy.Firstly,changing the concept of regulation and establishing a responsive legal system.The transformation of the concept is the first step in the regulation of the online car-hailing system.We should adopt an open,inclusive and innovative attitude to the online car-hailing service,and can not follow the old rules.Second,we should improve the regulations of the online car-hailing system from the central and local levels,removing unreasonable regulations.Third,we should strength the event and the post-regulation system,provide high-quality online ride-hailing services.Fourth,we should innovate regulation model,and establish government and enterprise cooperation regulation model.The government needs to change the model of the former single regulatory body and give full play to the role of the platform,joining with platform company to standardize and promote the development of online car-hailing services.
