Research On Professional Ethics Of Public Lawyers In My Country

Professional ethics of public lawyers is the code of conduct that public lawyers should follow in their legal work.Public lawyers have dual attributes in their identity.In view of this characteristic,its professional ethics should be distinguished from the professional ethics of other forms of lawyers.In particular,compared with social lawyers,public lawyers need professional ethics for public lawyers in addition to complying with the norms of practice.However,the lack of corresponding professional ethics rules and system protection,public lawyers face professional ethics problems are increasingly prominent.This paper takes the public lawyer in the lawyer profession as the research object,through the contrast analysis with the social lawyer,the public official professional ethics,explores the public official lawyer under the dual status should follow the professional ethics,and discovers the existence question,in order to perfect our country public official lawyer professional ethics.In addition to the introduction and conclusion,the article is divided into four parts:The first chapter mainly analyzes the definition and characteristics of professional ethics of public lawyers,distinguishes the concepts of public lawyers,ethics and professional ethics,and further analyzes the characteristics of professional ethics of public lawyers.The second chapter is mainly about the duty,mission and professional ethics requirements of public lawyers.For the role of public lawyers,it expounds their duties and missions in the process of rule by law in China.Then,combined with the professional ethics norms of lawyers and public officials,the special status of public lawyers and the requirements of professional ethics in the job are discussed.The third chapter mainly through the public office lawyer dual identity carries on the contrast,analyzes the lawyer and the public official different profession attribute,discusses the public office lawyer identity transformation process the interest conflict,the public office lawyer dual role causes the professional ethics conflict,the public office lawyer autonomy insufficiency and the impartiality deviation and so on professional ethics question.And the causes of this problem are analyzed one by one.The fourth chapter is mainly based on the problems and causes of professional ethics mentioned in the previous chapter,and tries to improve the professional ethics rules of public lawyers,strengthen the construction of professional ethics of public lawyers,and strengthen the internalization of professional ethics of public lawyers.
