Investigation Report On Legal Protection Of Traditional Buildings In Gaodang Village, Zhenning County

Gaodang Village,Zhenning County,Guizhou Province,is rich in traditional buildings.The traditional buildings in this area were listed as provincial cultural relics protection units in 2015.Traditional buildings in Gaodang Village,including cultural relic buildings and traditional style buildings,are damaged to varying degrees,and many traditional residential buildings are vacant.Traditional architecture contains rich traditional culture and is also an important tourism resource.Strengthening the legal protection of traditional architecture is of great significance to cultural heritage,tourism development and Rural Revitalization.However,from the investigation,there are some deficiencies in the legal protection of traditional buildings in Gaodang Village,such as unreasonable legal provisions,lack of protection awareness,weak law enforcement and supervision,incomplete protection scope,marginalization of judicial protection and so on.Further analysis of the reasons showed that the main causes were strict restrictions on the repair standards,unreasonable provisions on rights and responsibilities,incorrect concept of law enforcement and protection,imperfect law enforcement and protection mechanism,insufficient funds for protection,imperfect judicial protection mechanism for cultural heritage,and absence of public interest litigation system for cultural relics.Therefore,in practice,the following improvements can be made: to formulate protection management regulations with reasonable repair standards and detailed compensation system;Establish consensus on protection priority,improve law enforcement and protection mechanism,and implement comprehensive and diversified protection;We will improve the judicial guarantee mechanism and establish a public interest litigation system for cultural relics.Except for the introduction part,the article have the following four sections:The first chapter introduces the concept of traditional architecture and the necessity of legal protection of traditional architecture in gaodangzhai,Zhenning County.The second chapter introduces the time,content and method of the investigation,as well as the investigation results of the general situation of gaodangzhai traditional architectural remains,law enforcement and judicial protection.The third chapter summarizes the shortcomings of legal protection of traditional buildings in gaodangzhai in legislation,law enforcement and judicial protection from the relevant legal provisions,law enforcement protection measures and related judicial protection activities.The fourth chapter analyzes the reasons for the deficiencies of the legal protection of traditional buildings in gaodangzhai in legislation,law enforcement and judicial protection.The fifth chapter: in view of the shortcomings in the legal protection practice of traditional buildings in gaodangzhai,it puts forward suggestions from three aspects:formulating specific protection regulations,improving the efficiency and level of law enforcement protection and strengthening the judicial protection.
