Research On The Jurisdiction Of Internet Courts In China

In recent years,the impact of information and communication technology on various fields of society is deepening.In the context of judicial reform and network power,China has set up three Internet courts in Hangzhou,Beijing and Guangzhou to solve network related disputes and gradually adapt to the Internet Ecology.From the actual effect,this new field of reform is in good condition,which is of positive significance to promote the innovation of trial mode and carry forward the spirit of rule of law.But at the same time,it also faces difficulties and challenges.On November 17,2018,the first National Academic Conference on the trial procedures and rules of Internet court cases was held in Beijing.The opening of the meeting is to discuss the jurisdiction of the Internet court.It can be seen that the jurisdiction of the Internet court still needs to be improved.Therefore,this paper studies the jurisdiction of Internet courts in China.The whole article is divided into four parts.The first part is the theoretical study of the jurisdiction system of China's Internet courts,mainly for the introduction of the origin of the new field and the jurisdiction system;the second part is the investigation of the current situation of China's Internet court jurisdiction,through the analysis of the current situation of centralized jurisdiction and the practice of the three courts,aiming to find the existence of the three Internet courts in China The third part is the investigation of the jurisdiction system and reform of the extraterritorial Internet court,and draws inspiration according to the provisions,achievements or failure experience of the jurisdiction of various countries;the fourth part contains the idea that how to build up a perfect jurisdiction system of Internet court in China.Positioning is the basis of solving the jurisdiction problem.Therefore,the author first makes clear the positioning of the Internet court.Secondly,understand the current situation of China,borrow foreign experiences and use it for reference to build an jurisdiction of Internet Court.Finally,within the framework of clear jurisdiction,reshape the jurisdiction rules,solve the contradiction with the regional jurisdiction rules,give the parties the right to choose,and improve the jurisdiction system,so as to form the Internet court jurisdiction system with Chinese characteristics.In order to help the process of Internet court litigation,and explore the Chinese model and rules of Internet court jurisdiction.
