Research On The Delimitation Of The Outer Continental Shelf In The Arctic Region

Rising global temperatures have accelerated the melting of Arctic ice,exposing the rich Marine resources of the Arctic region to the world.The great improvement of science and technology has brought the natural resources of the Arctic to the international view,causing the Arctic countries to compete for it.At the same time,non-Arctic countries are also jumping into the "enclosure" battle.In addition to disputes over maritime delimitation,the management of shipping routes,scientific research and ecological and environmental protection,the issue of the outer continental shelf delimitation is the most difficult and important one.The broad implications of the issue of the demarcation of the outer continental shelf are obvious.Now the Arctic countries have submitted delimitation applications to the Commission on the Limits of the Continental Shelf.The trend of delimitation of the outer continental shelf is unstoppable.It is no longer possible to apply the Arctic issue to the Antarctic issue.Therefore,it is extremely urgent to grasp the key of the Arctic issue,explore practical solutions,safeguard the common waters of the international community,and reduce the disputes among Arctic countries.This issue involves not only the eventual allocation of the rich resources of the Arctic,but also the subsequent governance of the Arctic region.It also involves the size of the common seabed area of the international community.Therefore,the Arctic issue bears on the vital interests of every country,and it is not advisable to stay aloof from the situation.Countries should strengthen their participation in Arctic demarcation affairs,enhance their voice on the Arctic issue,and safeguard peace and stability of the international community.This paper is mainly composed of three parts: introduction,body and conclusion:The introduction mainly summarizes the development process and research status of the issue of the delimitation of the Arctic outer continental shelf,highlighting the importance and urgency of the Arctic issue,and then introduces the research ideas and methods of this paper.The first chapter mainly introduces the status quo and influence of the outer continental shelf demarcation in the Arctic region.The first chapter introduces the concept of the outer continental shelf,and then summarizes the impact of the outer continental shelf demarcation on Arctic countries and non-Arctic countries from several aspects.The second chapter mainly introduces the legal source basis and institutional norms of the outer continental shelf delimitation,focuses on the analysis of the application effect of the United Nations Convention on the Law of the Sea(UNCLOS)in the Arctic waters,summarizes the shortcomings of the existing norms,and provides a theoretical basis for the subsequent proposal of governance;The third chapter enumerates the application cases submitted by the Arctic countries,and analyzes the reasons for the obstruction of the adoption of the demarcation and the interests among them from the review results of the applications.In addition,the author selects two representative cases from all the applications received by the Continental Shelf Commission for reference to provide theoretical support for the constructive suggestions in Chapter IV.The fourth chapter puts forward specific solutions based on the above-mentioned problems.Firstly,from the perspective of international law,the deficiency in the system is improved,and the special outer continental shelf delimiting treaty is concluded,and then the dilemma of regional overlapping is solved by bilateral or multilateral agreements between the disputing countries.Forming an all-around perfect ideal system of system level,practical review and process supervision.Third,in the conclusion part,through the above text part of the problem and experience summary for concise summary,highlight the center of this article.Finally,the author hopes to promote more scholars to participate in the discussion of the Arctic issue through the author's humble opinions and play the role of casting a stone and attracting jade.
