Research On Legal Issues Of Sexual Harassment

“Sexual harassment”used to be a taboo issue for most Chinese.However,with the progress of The Times,the improvement of human rights protection awareness and the rise of women's awareness,numerous sexual harassment incidents have aroused the concern of all members of the society and become a hot social issue.Sexual harassment happens frequently in real life.Whether it is in open public places,relatively closed workplace environment or teaching campus,it is more and more troubled by sexual harassment.However,due to the lack of legal provisions,the judges in practice are often inconsistent.Article 1010 of China's Civil Code stipulates the prohibition of sexual harassment and the duty of prevention and treatment of each unit,which is a great advance in the process of anti-sexual harassment.However,it is too simple and needs to be further improved in all aspects in order to better govern sexual harassment.This paper first analyzes the basic theory of sexual harassment,defines the concept of sexual harassment,characteristics and different ways of behavior and discusses and analyzes the specific legal interests of sexual harassment violations,to understand sexual harassment behavior in a diversified way.Secondly,from the perspective of practice,workplace,and campus respectively in this paper,the public field,three high frequency sexual harassment issues,introduced by cases,social hot spots,analyze the hazards and characteristics of different field performance harassment,management difficulties,and so on theoretical issues,to study the essence of the sexual harassment behavior and deeper problems,summarized the practice experience for cut the sexual harassment behavior;Finally,it provides perfect suggestions for the prevention and treatment of sexual harassment in China,creating a harmonious social environment,improving the legislative provisions of sexual harassment,and improving the prevention and treatment of sexual harassment in three fields.From the perspective of civil law,a more comprehensive legal network against sexual harassment should be constructed within the above three dimensions.In a word,the combination of law and social security mechanism to curb sexual harassment is a systematic project of comprehensive social governance.It is necessary to build a closed loop of social prevention and control against sexual harassment,so as to lay a solid legal foundation for protecting the rights and interests of the harassed.
