Today in the information age,the network and daily life become inseparable,It is worth mentioning that the Internet does bring efficiency and convenience to our life and work.However,it can not be denied that the use of any technology has a double-sided effect,From the beginning of the birth of the network to the extensive application.The frequent occurrence of the use of network tort crimes in practice should also be worth our thinking.In particular,with the rapid development of media in recent years,the platform for citizens to express their opinions has become wider,and everyone can express their views and opinions on their personal accounts.Admittedly,there is nothing wrong with citizens expressing their right of speech and safeguarding their legitimate interests through public platforms,but the right to freedom of speech is easily abused.In this process,such phenomenon also appeared one after another,Some netizen begin to maliciously attack and insult others with words online,publish false information to defame others or illegally obtain other people's information and make it public on network social platforms.On the one hand,the increase of online abuse and vulgarity has seriously infringed on the right of reputation and privacy of other citizens.On the other hand,it has also had a negative impact on the current order of Internet space.Therefore,sufficient attention must be paid to this problem.How to effectively control the phenomenon of Internet violence and reduce the infringement on the parties have become a hot topic of current discussion and research while protecting citizens' right to freedom of speech.This paper mainly analyzes the forms of network violence,points out the problems and deficiencies existing in the current legal regulation,tries to solve these problems,and gives the specific path of governance of network violence.This paper consists of five parts.The first part is the introduction,which introduces the reasons for the topic selection,as well as the current research on Internet violence at home and abroad,At present,the domestic research direction is mainly from the definition of network violence governance problems and other aspects of research;The second part is the theoretical analysis of Internet violence,combined with the problems existing in the case,put forward their own thinking Angle,thus introducing the topic of Internet violence research;The third part begins to introduce the definition of network violence in academic theory and the necessity of regulating this behavior;The fourth part analyzes the relevant provisions in the legislative and judicial interpretations of network violence in China,It also points out the difficulties in identifying the responsible person and the lack of relief channels for the right holders in the regulation;The fifth part is the last part of the article,focusing on the regulation measures,It analyzes that the legislation level should perfect the responsibility system and strengthen the protection of personal information right.Judicial aspect to determine the jurisdiction of the use of preliminary temporary injunction,and law enforcement to strengthen the supervision of public opinion and law-abiding level to emphasize the industry self-discipline and correct guidance and other measures.
