The "Rules on Educational Punishment of Primary and Secondary Schools(Trial)"(Order No.49 of the Ministry of Education,hereinafter referred to as "the Rules")clarifies that educational punishment is a legal punishment with educational significance for specific education and teaching,and it is a bad idea and deviant behavior for students of an educational way.This article analyzes the meaning of educational punishment and corporal punishment through the literature research method,and clearly defines the conditions and methods of the implementation of educational punishment based on the "Rules".In addition,interviews and questionnaires were used to investigate the status quo of educational punishment in high school biology teaching.In view of the problems found,rationalization suggestions were put forward based on the existing laws,regulations and Rules,so as to provide reference for biology teachers to reasonably implement educational punishment.Through the analysis of the results of student questionnaires and teacher interviews,it is found that in terms of students:(1)High school students generally confuse the concepts of educational punishment and corporal punishment;(2)Lack of understanding of the illegal act of corporal punishment and weak legal awareness;(3)Lack of awareness and ability to defend rights after being subjected to unreasonable corporal punishment.In terms of teachers:(1)Some biology teachers did not dare to punish,for fear of causing criticism,they transferred the right of punishment to the class teacher or their parents,and their legal awareness was insufficient;(2)Some biology teachers ignored the purpose of educational punishment and pursued student achievement excessively,Advocating strict management.Although student performance has been temporarily improved,it is not conducive to the long-term and healthy development of students' body and mind.Educational concepts need to be updated;(3)Some biology teachers will not choose the appropriate punishment method when necessary,and the punishment method is single.The punishment effect is not good;(4)Some biology teachers have difficulty grasping the reasonable boundaries of educational punishment,which leads to excessive punishment and turns into corporal punishment.In terms of schools:(1)Most of the class rules are made by teachers and schools,students are not involved;(2)There is a lack of transparency.Drawing on the experience of foreign countries in the way,procedure and system of educational punishment,under the guidance of Chinese laws,regulations and Rules,combined with the characteristics of high school education and teaching in China,and aiming at the problems existing in the questionnaire and interview,the following suggestions are proposed:(1)The combination of punishment and other educational means(reward)for biology teachers;(2)Biology teachers need to improve their own quality,enhance legal awareness,resist corporal punishment,legalize punishment methods,and update educational concepts,adhere to education first;(3)Biology teachers should clarify the boundaries of educational punishment,use punishment cautiously,and strictly eliminate corporal punishment;(4)Clarify the principles of educational punishment and implement punishment flexibly;(5)Teachers,students,parents and school leaders jointly negotiate the formulation of class rules and school rules to ensure the legalization and transparency of the implementation procedures of educational punishment;(6)Within the scope of the school,conduct comprehensive supervision on teachers' disciplinary behavior from the two levels of the school and students.
