| The ocean is the cradle of life and an important space for human survival and development.The rich biological resources in the ocean provide countless functions and benefits for human beings and have inestimable value.However,with the increasing exploitation of the ocean by human beings,the function of maintaining marine biodiversity has been gradually destroyed.For the future of human society,it has become the consensus of people all over the world to stop the degradation of marine environment and to protect and maintain marine biodiversity.Nowadays,the international community has formulated more complete related laws and regulations and established protection systems to prevent the degradation of marine ecosystem and the loss of marine biodiversity.With the advent of the digital era,modern information technology,represented by satellite remote sensing,drone remote sensing,big data,cloud computing,Internet of Things,block chain,artificial intelligence,etc.,has been widely used in marine resource development,marine environmental protection and comprehensive marine management,providing technical support for mankind to understand the ocean comprehensively and develop it scientifically and rationally.Modern information technology is also widely used in the protection of marine biodiversity,promoting the protection of marine biodiversity to be more reasonable and ensuring the sustainable development of marine biological resources.The law is the primary means of marine biodiversity protection,and other means must be subordinate to or compatible with the law,and be exercised within the scope determined by the law.Thus,the law plays two roles in marine biodiversity conservation: first,as a direct means to protect marine biodiversity.Secondly,it provides a guarantee for other instruments to make them institutionalized and scientific,and reasonably allocates material,financial and human resources,so that other instruments can play the best role in the protection of marine biodiversity.Modern information technology has provided important scientific support for marine biodiversity conservation,and has received more and more attention from more and more countries,and countries around the world have begun to integrate modern information technology factors in the process of revising and improving old rules and formulating new ones.However,while modern information technology continues to develop in the protection of biodiversity,it also brings new challenges to the construction of the legal system,putting forward higher requirements on the form of legal sources and the legal rule system,and the law should respond to digital technology.Against this background,this paper not only discusses the first role of law,but also focuses on the second role of law as an institutional safeguard for digital technology.Chapter 1 is an introduction,which introduces the background and significance of this paper,as well as the research methodology and the main innovation points.Chapter 2 introduces the influencing factors of marine biodiversity,the main threats to biodiversity in the South China Sea,and analyzes the relationship between modern information technology and law in the field of marine biodiversity conservation.Chapter 3 analyzes the legal system of marine biodiversity conservation in the digital era in various countries around the world,focusing on the provisions of digital technology in the legislation of each country in the analysis.Chapter 4 summarizes the scientific and legal practices of biodiversity conservation in the South China Sea,and identifies problems and shortcomings on this basis.Chapter 5 will combine the previous discussion and put forward specific suggestions for the adaptation of China’s legal system for biodiversity conservation in the South China Sea to the digital era. |
