Study On The Problems And Countermeasures Of Vehicle Exhaust Regulation In Sichuan Province

Urban air pollution is one of the serious environmental problems faced by all countries in the world.The governments of all countries pay more and more attention to the effective prevention and control of air pollution.In recent years,the number of motor vehicles in China has increased rapidly,and the problem of exhaust emission pollution has become increasingly prominent.Problems such as excessive vehicle emissions,poor quality fuel,and the absence of environmental supervision of non-road mobile machinery have become the focus of the public’s attention.Environmental monitoring authorities released data showing that vehicle emissions of pollutants,including PM2.5,ozone and other pollutants exceeding the standard weather contribution rate is high,led by diesel trucks.Vehicle exhaust emissions have become an important source of air pollutants,which is one of the main causes of urban haze in autumn and winter and excessive ozone in summer.The author is one of the main drafters who participated in the whole legislative process of Sichuan Province Measures for the Prevention and Control of Exhaust Pollution by Motor Vehicles and Mobile Machinery.Through investigation and discussion,on-site visits and other methods,the legislative needs were consulted from provincial departments,grass-roots ecological and environmental protection departments,emission inspection institutions and industry associations.Taking the legislative work as an opportunity,the paper has extensively collected the bottleneck problems that need to be solved in the actual work of vehicle exhaust pollution supervision in this province.At the same time,the author organized an expert consultation meeting composed of university teachers,lawyers and advisers,legislative members of the judicial system,etc.,to demonstrate and put forward countermeasures to solve the difficulties in vehicle exhaust regulation from multiple perspectives.This paper analyzes the present situation of automobile exhaust pollution and automobile exhaust regulation in Sichuan Province.This paper analyzes the problems existing in automobile exhaust supervision in Sichuan Province,and explains in detail the problems such as insufficient coordination of departments,shortage of supervisory personnel,insufficient hardware configuration and controversy of relevant legal basis in terms of legal system,capacity building and supervision mechanism.It is pointed out that the current situation of supervision can not meet the situation of the rapid growth of the number of motor vehicles.Focusing on the in-depth analysis of the legal level,this paper discusses in detail the vague definition of the current relevant laws on the illegal situation of motor vehicle inspection institutions,the conflict of the basis for the punishment of motor vehicle inspection institutions,and the controversy on the legality of the punishment of the sampling test of motor vehicle supervision.It is pointed out that the deeprooted reasons for the lack of supervision and enforcement of motor vehicle exhaust gas are largely due to the lack of legal support,which leads to the ambiguous positioning of many departments in their work,unable to follow the laws,and the difficulty of enforcement.The regulatory problem is not that the government does not act,but that the government does not dare to act recklessly.Based on the theory of new public management and the theory of government regulation,this paper puts forward countermeasures and suggestions from the aspects of optimizing the supervision mechanism of motor vehicle exhaust gas,strengthening the supervision capacity construction of motor vehicle exhaust gas,and perfecting the regulation law of motor vehicle exhaust gas.Countermeasures and suggestions include clarifying the functions and responsibilities of government departments,increasing investment in equipment to improve scientific and technological support,and enduring the effectiveness of surveillance sampling evidence,etc.On the legal side,under the principle of not arbitrarily increasing the penalty standards,expanding the penalty objects and increasing the burden on the public,the author put forward suggestions on improving the provisions that are not legally operable in the supervision of motor vehicle exhaust and some blind spots in supervision.Thus,it can provide useful reference for Sichuan Province to carry out the motor vehicle exhaust regulation and better protect and improve the atmospheric environment.
