Research On The Judicial Protection Of Wildlife In China

In October,2021,the 15th meeting of the Conference of the Parties to the Convention on Biological Diversity was held in Kunming,China,and both at home and abroad paid great attention to the topic of biodiversity conservation.This is also the first global conference held by the United Nations with the theme of ecological civilization.Its purpose is to promote the construction of ecological civilization all over the world,and it emphasizes efforts to realize the sustainable utilization and benefit sharing of biodiversity on the basis of respecting,adapting to and protecting nature.As an important part of species diversity,wild animals are the concentrated expression of species richness and the main object of biodiversity protection.From the perspective of biodiversity protection,this paper first affirms the value of wildlife to economic,cultural and ecological society,and then highlights the achievements of wildlife protection in China by integrating the global biodiversity protection situation,and further emphasizes the significant role of law and justice in wildlife protection.The judicial protection of wild animals refers to the means of protecting wild animals implemented by judicial organs of our country by judicial power and procuratorial power.This paper analyzes the existing problems of judicial protection of wild animals in our country at present,and puts forward the corresponding improvement ways.There are still some defects in the public interest litigation system of wildlife protection,the effect of judicial punishment is not ideal,and disputes in judicial practice are all prominent problems in the process of wildlife judicial protection.We should improve the public interest litigation system of wildlife protection,improve the application of restorative justice in wildlife protection,and correctly handle the disputes of wildlife judicial protection.As an important part of judicial operation,it also provides a solid backing guarantee for wildlife protection.At the same time,it is necessary to continuously strengthen public participation and democratic supervision.By establishing a perfect public interest litigation system in the field of wildlife,we can gather all forces to form a joint force for wildlife protection,create a beautiful home for wildlife,lay a solid foundation for biodiversity protection,and promote the realization of the beautiful vision of harmonious coexistence between man and nature and the common expectation of enriching biodiversity.
