Research On Legal Issues Of Garbage Disposal PPP Projects

MWith the development of China's urbanization becoming more and more full,people's economic life is getting better and better,and the demand for a better environment is also gradually increasing.Accordingly,with the increasing urban living garbage,people become the biggest obstacle to meeting this demand Obstacles,but also because of municipal solid waste will bring water pollution,air pollution,soil pollution,a vicious cycle,the solution to urban garbage problem without delay.However,the problem of municipal solid waste has a long history,and the original legal norms in our country are not enough,which lags behind the law itself.It is not enough to solve the current and future urban solid waste problems.Now we must seek a new Governance model based on the improvement of relevant laws and regulations to solve the problem of urban living garbage governance dilemma.The development of China's PPP model has undergone five stages:from the proposal to the small-scale pilot to the large-scale promotion to the standardization.The PPP model is applicable to the waste treatment industry and it has certain certainty.However,how does PPP meet the requirements of waste disposal?The environmental protection needs,how to solve the garbage disposal project The full implementation of the PPP model is the key to this article.Based on public goods theory and government failure theory,this article uses literature research,comparative research,and empirical analysis as research methods.After an overview of the PPP model,it analyzes the current situation of domestic waste management in China,and combines the "government and social capital cooperation method".(Draft for Soliciting Opinions),Law of the People's Republic of China on the Prevention and Control of Environmental Pollution Caused by Solid Waste,Regulations on the Management of Urban Appearance and Environmental Sanitation,and Measures for the Management of Urban Domestic Waste,etc.Under the guidance of the theory of public goods,we analyze the difficulties faced by the full implementation of the PPP model in China's waste disposal currently from three aspects:imperfect laws and regulations,environmental risks,and government oversight responsibilities.The induction issues are concentrated in four aspects:First,regulations,and legal norms Imperfections,including the contradiction between laws and regulations throughout the life cycle of the PPP model;Secondly,environmental risk prevention,awareness of environmental risk prevention has not been reflected in the "government and social capital cooperation(draft for solicitation of comments)";Third,the government supervision responsibility,The government lacks effective supervision over waste disposal.According to the current problems of urban domestic waste management in China,drawing on the successful experience of developed countries in the PPP model,based on the necessity and feasibility of applying the PPP model to the treatment of domestic waste,trying to improve the laws and regulations,establish a model that can be copied and replicated.Governance model,and put forward a feasible path to this.
