Marine debris pollution is one of the key environmental issues that countries are currently focusing on.Among the various types of marine debris pollution,plastic debris pollution is particularly severe and has not yet received sufficient attention from legislators in China.It not only causes serious harm to marine ecology,but also poses a threat to human health.If not curbed,it will inevitably lead to more serious economic losses.Analysis of the current laws and regulations related to the prevention and control of marine debris pollution in China,as well as the content related to pollution control in the Solid Waste Pollution Prevention and Control Law,reveals that the existing legal system is unable to fully address the diverse problems of marine debris pollution.As a responsible major country,China should set an example in the field of marine debris pollution prevention and control,improve domestic legislation,improve the surrounding marine environment,and build a beautiful China.To further improve the legal system related to the prevention and control of marine debris pollution in China,we should base ourselves on China’s practical needs,compare foreign legislative experiences,reflect and learn from them,and improve our existing legal system.Specifically,in terms of the prevention and control of marine debris pollution,the United States,Japan,and the European Union have already formed relatively complete legal systems,which can provide guidance for China’s activities such as standardization,monitoring,and cleaning of marine debris,and propose a conceptual framework for China’s legal system for marine pollution prevention and control based on this foundation.This article clarifies the current situation and legal issues of marine debris pollution prevention and control,and proposes targeted improvement suggestions based on relevant foreign experiences from the perspectives of guiding principles and institutional systems,in order to optimize China’s legal system for marine debris pollution prevention and control and ensure the integrity of the relevant legal system structure.Specifically,on the one hand,since land-based emissions are the main cause of marine pollution,the principle of land-sea coordination should be adhered to,and the prevention and control of land-based pollution should be strengthened to prevent marine debris pollution at the source.On the other hand,based on the special nature of the causes of marine debris p This article clarifies the current situation and legal issues of marine debris pollution prevention and control,and proposes targeted improvement suggestions based on relevant foreign experiences from the perspectives of guiding principles and institutional systems,in order to optimize China’s legal system for marine debris pollution prevention and control and ensure the integrity of the relevant legal system structure.Specifically,on the one hand,since land-based emissions are the main cause of marine pollution,the principle of land-sea coordination should be adhered to,and the prevention and control of land-based pollution should be strengthened to prevent marine debris pollution at the source.On the other hand,based on the special nature of the causes of marine debris pollution,especially the increasingly severe pollution caused by plastic marine debris,the principle of key control should be adhered to in the prevention and control of marine debris pollution,and the institutional construction of plastic debris control should be strengthened.Therefore,based on the principles of land-sea coordination and key control,a system should be established that integrates reduction and control,resource utilization,harmless disposal,monitoring and early warning,and compensation for damages for the prevention and control of marine debris pollution.ollution,especially the increasingly severe pollution caused by plastic marine debris,the principle of key control should be adhered to in the prevention and control of marine debris pollution,and the institutional construction of plastic debris control should be strengthened.Therefore,based on the principles of land-sea coordination and key control,a system should be established that integrates reduction and control,resource utilization,harmless disposal,monitoring and early warning,and compensation for damages for the prevention and control of marine debris pollution.
