| The complex relationship between human activities and the ecological environment,which is sometimes harmonious and sometimes conflicting,has almost always been accompanied by the development of human society.With the continuous progress of society and the rapid development of the economy,the contradiction between humans and nature has become increasingly intense,and environmental problems have occurred frequently,presenting characteristics such as large pollution area,high difficulty in restoration,wide impact range,and long duration.People are gradually realizing that protecting the environment is not only an obligation of the state,but also a responsibility of everyone.The principle of public participation is an important legal basis for environmental law.In the continuous development of environmental law,environmental impact assessment has become increasingly valued as a preventive environmental protection system.Without public participation,there is no environmental impact assessment.The level of public participation in the process of environmental impact assessment plays a crucial role in a country’s ecological environment protection.The environmental impact assessment system in China has undergone historical development and has achieved certain achievements.However,due to the long-term influence of administrative factors,the importance of public participation in China’s environmental law is not high,and there is ambiguity,lag,and confusion in legislation,resulting in poor operability of public participation and failure to play its rightful role in environmental protection.In this paper,the author takes the relevant legal issues of public participation in environmental impact assessment system in China as the main research object,lists the current research situation in this field at home and abroad,and expounds the basic legal theory behind it.Through collecting and sorting out the information data of several public participation descriptions in various leagues and cities of Inner Mongolia,the author makes statistics,combines the current situation of public participation in environmental impact assessment in China,and explores the main existing problems,Drawing on the practical and feasible legislative experience of foreign countries for our country,combined with specific national conditions,the author proposes a path for improvement,in order to make some shallow but substantive suggestions for research in this field,and contribute to the construction of China’s "ecological civilization" and "beautiful China". |
