Research On China’s Wildlife Lists Management System

The wildlife list in this paper refers to the compilation of the names of wildlife species protected by law,which has the functions of saving endangered species,maintaining biodiversity and ecological balance,regulating wildlife use behavior,and preventing and controlling wildlife epidemic.At present,the vast majority of countries adopt the directory system to determine the scope of wildlife protected by law,and a sound wildlife directory management system is the premise of national legal protection of wildlife.China’s wildlife species list system consists of two parts:protection list and artificial breeding list.The former includes national key protected wildlife list,national key protected terrestrial wildlife list with important ecological,scientific and social values and local key protected wildlife list,The latter includes the list of national key protected terrestrial wildlife and the list of national key protected aquatic wildlife.Through the investigation of the above-mentioned list making subject,listing object,classification standard,making procedure and adjustment procedure,the problems existing in China’s wildlife list system are sorted out: at present,the establishment of the list making subject at the national and local levels is not conducive to the realization of the function of the list system;Due to the unclear definition of the adjustment objects and functions of each directory,the directory system is relatively bloated,and there are overlapping functions among the directories;There is no clear inclusion and classification standard for each directory,which leads to the damage of the scientific nature of the directory and is not conducive to the coordination and unification of the directory system;Lack of statutory directory development process,lack of public participation in the actual development process;Most of them have not been revised for a long time,which has lagged behind the actual change rate of wild population;In addition,the current wildlife list system does not involve the content of public health and safety,and the function of the list system to prevent and control wildlife epidemic has not been played.In view of the above problems,the author inspected the representative wildlife list management system of the United States,namely the Endangered Species Act and the endangered species list of the United States,and summed up the beneficial experience of the United States in the formulation of the main body,formulation procedures,enumeration scope and formulation criteria of the wildlife list,In order to strengthen the ecological function of wildlife protection list as the ultimate goal,this paper puts forward some suggestions for the improvement of China’s system: the competent forestry department should be determined as the single main body of making the list,and the State Council and provincial people’s government should retain the authority of making the list;We should clarify the functions and protected objects of the directory,merge the similar directory,complete the missing directory,and build a two-dimensional directory system of national directory and local directory,key protection directory and artificial breeding directory;Focus on the protection function of the directory,and build a scientific,reasonable,unified and clear listing and grading standard;Determine the procedures for the establishment of the directory to ensure full scientific argumentation and effective public participation;Establish a dynamic updating procedure of the directory combining regular adjustment with emergency adjustment;The list of epidemic focus species shall be formulated and shall be prohibited from being included in the list of artificial breeding.
