Study On The Circulation Of Contracted Grassland Management Rights In Inner Mongolia

Grassland is the important natural resource of broad farming and pastoral areas in China,the foundation of herdsmen survival and the foundation of economic development of livestock husbandry.The lawful and orderly transfer of the contracted management rights of grassland concerns the fundamental interests of thousands of herdsmen.It is the inevitable requirement for the optimal allocation of grassland resources,the improvement of economic benefits of grassland,and the upgrading of the industrial structure of pastoral areas.It plays an important role in promoting the healthy economic and social development of pastoral areas.The transfer of contracted grassland management rights in Inner Mongolia Autonomous Region has formed its own characteristics.With more and more disputes in various types of grasslands in pastoral areas,Needs to improve the transfer mechanism of contracted grassland management rights.It is of great significance to carry out research on the transfer of contracted grassland management rights in Inner Mongolia Autonomous Region.This study is divided into four parts:The first part is an overview of the transfer of contracted grassland management rights.The concept of grassland contracted management right,the transfer of grassland contracted management right,the form of transfer and other concepts were defined,and the object of this study was clearly defined.On the basis of comparing the general rural land contract,this paper analyzes the particularity of the transfer of grassland contract management right.Using Pareto theory,property right theory,transaction cost theory,Marxist ecological economics theory to analyze the economic principle of grassland contract management right transfer.The second part is the current situation of the transfer of contracted grassland management rights in Inner Mongolia.From the perspective of legal basis,this paper analyzes the current legal norms of the transfer of grassland contract management rights,analyzes the current situation of the transfer of grassland contract management rights in Inner Mongolia from the perspective of transfer practice,and makes a brief analysis on the area,form and direction of the transfer.The third part of Inner Mongolia grassland contract management rights of the transfer of legal issues.In terms of legal norms for the transfer of contracted grassland management rights,there are some problems,such as too principled legal norms,lack of operability,not obvious legislative characteristics,legislation is not unified,and dispute resolution procedures are not perfect.In terms of the law enforcement of the transfer of grassland contracted management rights,there are some problems,such as the lack of registration before the transfer,the lack of supervision after the transfer,and the lack of law popularization.In terms of the transfer market of grassland contract management rights,there are some problems,such as poor market circulation,opaque market price and short-term rental.The fourth part of Inner Mongolia grassland contract management right transfer system improvement suggestions.In terms of the legislation related to the transfer of contracted grassland management rights in Inner Mongolia,it is suggested to enhance the operability of legal provisions,strengthen the characteristics of local legislation,timely amend laws and regulations,and improve the dispute settlement mechanism.In terms of administrative law enforcement of the transfer of contracted grassland management rights in Inner Mongolia,it is suggested to speed up the work of grassland right confirmation and registration,improve the transfer supervision system,and increase the publicity of the law.In terms of the construction of the market for the transfer of contracted grassland management rights in Inner Mongolia,it is suggested to promote the construction of the transaction market for the transfer of property rights,appropriately encourage the transfer of grassland,and cultivate grassland transfer brokers in pastoral areas.
