Research On The Legal Issue Of Auxiliary Police Of Public Security Organs

The existence of auxiliary police personnel has the particularity of The Times,is the current "police collaboration" mode,for the need of the police,police auxiliary police identity,has become an important force of auxiliary police law enforcement,to a certain extent,alleviate the shortage of grassroots police,but in the process of police auxiliary police enforcement also exposed many problems,damage the public security organ law enforcement work image.It is of very important value to standardize the management of auxiliary police personnel to promote the healthy development of auxiliary police teams and improve the quality of law enforcement of public security organs.Auxiliary police personnel system after years of development,in maintaining social stability and unity,alleviate the lack of grassroots police,reduce administrative enforcement costs,but police auxiliary police enforcement behavior problems still exist:auxiliary police personnel auxiliary law enforcement legal attribute is not clear,to assist law enforcement rights source is not clear,the management system is not perfect,law enforcement procedure is not standard,responsibility and supervision mechanism is not sound.This paper thinks that police auxiliary law enforcement as the product of social governance,although there are various problems,but do not simply deny the necessity of the existence of police auxiliary police and its system,but through the analysis of police auxiliary law enforcement problems,positive interpretation "constitutional provisions",using the "public power theory of breakthrough theory" and "administrative process" police auxiliary law enforcement and power source legal analysis,to "administrative authorization","administrative entrust" and "administrative assistant" three theory,clear auxiliary police administrative assistant legal identity.At the same time,under the guidance of administrative supervision theory,standardize the auxiliary police enforcement mechanism,clarify the auxiliary police authority boundary,define auxiliary law enforcement scope,clear responsibility distribution between the subject,the introduction of public security organs,the masses,media public opinion and other forces of auxiliary police enforcement activities implement whole process supervision,in order to standardize auxiliary police personnel,management in accordance with the law.
