Problems And Countermeasures Of People’s Mediation Work In Yanbian Under The Perspective Of Social Capital Theory

The people’s mediation system has a long history.As the most ideal and important way to solve non-litigation conflicts and disputes,it plays an important role in maintaining social stability and rapidly preventing and resolving social conflicts.It is known as the "Oriental experience" and "the first line of defense".The report to the 19 th National Congress of the CPC pointed out,"We will strengthen and develop new mechanisms for resolving social problems and properly handle problems among the people." The fourth Plenary Session of the 19 th CPC Central Committee pointed out that "promoting the national governance system and capacity is a major strategic task of modernization." People’s mediation,as a main means of resolving disputes in social governance,tries to solve the problems at the grass-roots level and in the bud through this "flexible" means.However,in recent years,with the changes of social structure,people’s demands for a better life have become various.Especially after the release of the Civil Code,the socialist legal system with Chinese characteristics has been improved.The requirements for the legalization,standardization and specialization of people’s mediation are also increasing.There is still a certain gap between the current people’s mediation and the needs of the people,and there are some difficulties and problems that need to be solved and improved.This paper is based on social capital theory.Applied literature research method and interview method,following the logical relationship of "current situation of people’s mediation work--existing problems and causes--countermeasures and suggestions",this study firstly analyzes the current situation of people’s mediation work in Yanbian.It is concluded that the current people’s mediation work has the some difficulties,such as low recognition,imperfect policies and regulations,weak strength of the group and insufficient participation of all parties.On this basis,using the theory of social capital,we analyze the main causes of the problems.It is pointed out that the social trust foundation of people’s mediation organizations is weak,the social norms of people’s mediation are not specific,and the social network relationship of people’s mediation team is loose.Finally,the countermeasures are put forward from three aspects: activating social trust,strengthening social norms and relying on social network.Specifically,the foundation of people’s mediation is strengthened by carrying out publicity and education,enriching the service content and bettere playing the dominant role of mediation system.Improve the efficiency of people’s mediation by reinforcing the mediation working mechanism,strengthening the mediation support and guarantee,and establishing the supervision and assessment system.By standardizing the qualification treatment,improving the ability level and integrating resources,the people’s mediation can be strengthed.
