With the further development of Internet technology,the traditional consumption mode has changed,and the online shopping market is more and more prosperous.However,online shopping as an emerging consumption mode,brings hidden dangers to consumers who are in the vulnerable position while it provides convenience to consumption.The information asymmetry brought by the inherent malpractice of remote consumption mode has caused a large number of online consumption disputes.In order to adapt to the new needs of economic development and solve the new problems in social life.In 2014,the Latest revision of the Law on the Protection of Consumer Rights and Interests officially included the right to regret in the scope of legal protection,which is also an important step in the process of building the rule of law in China.But the law has limited and hysteresis quality,it is difficult to deal with the endless new problems.Therefore,it is necessary to further improve the norms about online shopping consumers’ right to regret,providing guidence for solving practical problemsBased on online shopping consumers’ right to regret as the research object,the thesis expounds and defines the concept and nature of consumers’ right to regret in the beginning,then differentiate the nature of the rights,revealing the essence of the system is to protect the legitimate rights and interests of consumers on the basis of the above introduction.And its value objective focuses on realizing substantial fairness,social overall efficiency and maintaining the real sense of freedom of contract.Through the research on the legislation of online shopping consumers’ right to regret and related supporting systems,we can see that there are still many problems to be solved in the exercise period,scope of application,exception provisions and excessive use of online shopping consumers’ right to regret.In view of China’s late start in the right to regret system,the thesis also takes Britain,Germany and France as examples to elaborate the provisions of consumers’ right to regret in foreign countries,for giving reference to our country.Considering the existing problems of online shopping consumers’ right to regret in China as well as the experience of other countries,corresponding suggestions for improvement are put forward: specifing the period of exercising rights,calculating the starting point and length of the period;roadening the scope of application of the right to regret,including wechat and cross-border e-commerce;improving the provisions of excluding the right to regret by refining the provisions,integrating the catalogue of goods,setting up confirmation procedures;ensuring the reasonable use of the right to regret by setting up the minimum quota of goods and establishing the credit evaluation systemas well as blacklist mechanism of online shopping consumers.
