Electricity trade is an important direction for the development of the global energy Internet,reflecting the concept of sustainable development and the idea of building a community with a shared future for mankind.Economic development depends on energy,in addition to non-renewable resources such as oil and natural gas,electricity is a green,efficient and environmentally friendly quality energy.Through international exchanges and economic integration,electricity trade has also developed from a smallscale,single trading market to a global openness.Carrying out international power trading through power grid interconnection is an effective way to regulate the surplus electricity of China’s power grid,optimize the allocation of domestic resources,and achieve win-win results,at the same time,based on the development of science and technology and the marketization of the power industry,as well as the opening of various countries to the power market,China’s power industry has become more and more prominent in the world.Cambodia is located in the middle reaches of the Lancang-Mekong River,an important node of the “21st Century Maritime Silk Road”and an important hub of the Belt and Road.The Rectangular Strategy and the Belt and Road that Cambodia has fully promoted in recent years have common development goals,and Cambodia’s economy has maintained rapid growth in recent years,and the gap between electricity supply and demand has continued to expand,making it imperative to trade electricity with Cambodia.Cooperation between China and Cambodia in electricity and energy trade has been taken seriously,but the process has been slow.Starting from the development of international electricity trade,this paper analyzes the basis of cooperation between China and Cambodia on power energy,discovers the potential of power trade cooperation between power grid interconnection,and tries to find the existing legal mechanism for electricity trade,on this basis,it focuses on the legal issues that China and Cambodia will face in power trade cooperation,and seeks reference significance from extraterritorial experience,so as to provide more effective legal protection for power trade between China and Cambodia and play a role in promoting.This article mainly includes four parts:The first part mainly summarizes the electricity trade between China and Cambodia.First of all,the development of international electricity trade is analyzed and the development characteristics are summarized.Secondly,the cooperation between China and Cambodia on electricity was summarized,and the potential for cooperation between Cambodia in terms of political mutual trust and economic development speed was found from the trade-related agreements signed in the past.The second part summarizes the legal mechanisms related to electricity trade and discusses the legal issues that China and Cambodia will face in electricity trade.Find available norms from mechanisms such as the WTO,and explore relevant legal bases through the Mechanism of the China-ASEAN Free Trade Area Agreement between China and Cambodia and the Framework Mechanism under the Greater Mekong Subregion.In addition,the problems to be faced will be raised in three aspects: China’s energy legal system,infrastructure construction contract model and electricity trade supervision mechanism.The third part analyzes the merits and shortcomings of Europe and North America in the construction of power grid-related laws,in order to summarize the reference significance of electricity trade between China and Cambodia.The European unified power grid has a sound legal and regulatory system,and in turn promotes the integration of the electricity market through the construction of the system;the regulatory problems in the North American joint power grid provide lessons for the regulation of electricity trade between China and Cambodia.In the end,it is proposed to think about the differences in practice of different regions while attaching importance to the construction of the legal system,and avoid blind reference.The fourth part proposes legal improvements for electricity trade cooperation between China and Cambodia.First of all,it is necessary to build a legal mechanism for electricity trade between China and Cambodia;second,we must improve the energy legal system,accelerate the promulgation of the Energy Law and establish a benign complementary relationship between laws and policies;third,avoid the risks of EPC contracts through laws and regulations,and give full play to the positive role of the Asian Infrastructure Investment Bank in power grid construction;and finally,we must establish a regulatory system for electricity trade and improve the regulatory principles and regulatory content.
