Study On Criminal Regulations Of Network Terrorism Crime In China

In today’s living environment where science and technology and human beings coexist and the unlimited coverage of the network,terrorism crime and the network are integrated,thus derived the network terrorism crime,which is difficult to control and more harmful.In essence,the network terrorism crime is still a kind of terrorist crime,is an individual,organization or state to achieve political,religious or other intentions,premeditated to network crime or network as criminal tool terrorist activities,to destroy national stability,endanger people’s lives,health and property security,create social panic of an intelligent terrorist crime.The object of its infringement is a complex object,and the behavior subject is a general subject containing organizations and individuals,and the subjective aspect is intentional.The emergence of cyber terrorism crime makes criminal law difficult in the evaluation of some traditional crimes and new behaviors.Under the impact of the network,the terrorist organization structure is loose,and the various terrorist crimes emerge under the influence of terrorist information on the network,while the domestic criminal laws on cyber terrorism crimes are scattered,and the connection between the current criminal law and the anti-terrorism department law is also insufficient.This series of problems have caused the weakness of criminal law in combating cyber terrorism crimes.In view of the existing problems,the beginning of the article elaborates and distinguishes the constitution and related concepts of cyber terrorism crime according to the convention,and introduces the characteristics and manifestations of the crime according to the definition analysis,so as to pave the way for the next research.After sorting out the current situation of criminal regulations and studying the regulation of countries outside the region,the specific problems and put forward the countermeasures to improve the criminal legal regulation of cyber terrorism in China.From the perspective of international law,we should pay attention to and give full play to the due role of international conventions and bilateral treaties,strengthen cooperation with various countries,and work together to fight cyber terrorism.From the perspective of domestic law,it is necessary to improve the legal system of cyber terrorism crimes as soon as possible,improve the level of criminal justice,clarify the concept of cyber terrorism and the identification system of criminal subjects,and integrate the substantive and procedural criminal laws,so that punishing criminals can have real laws to follow.
