Research On The Legal Issues Of Subsidy For Civilian Large Aircraft Under The Framework Of WTO

Large civil aircraft is the most important part of the strategic aviation industry.The independent research and development capabilities and manufacturing technology of large aircraft are a sign of the development level of the national aviation field.For the development of large aircraft,it is necessary to have a complete set of government subsidy rules.When my country’s self-developed C919 civil aircraft is about to enter the market,analyzing the WTO’s subsidy laws and regulations is practical for correctly understanding and judging whether a member’s policy,regulation,or measure constitutes a subsidy,what kind of subsidy constitutes,and what subsidy methods should be adopted.significance.This subject limits the research object to large civil aircraft excluding military aircraft and small civil aircraft,and the research object is the subsidy rules for large civil aircraft under the WTO framework.Based on the basic content such as the definition and classification of civil large aircraft subsidies,this paper analyzes the two major WTO legal rules on civil large aircraft subsidies,the Agreement on Subsidies and Countervailing Measures and the Civil Aircraft Trade Agreement.Through the case analysis method,it analyzes the large aircraft subsidy cases in the United States and Europe and the large aircraft subsidy cases in Canada and Brazil,and summarizes the types of subsidy involved in lawsuits based on the cases.To a certain extent,the fact that Boeing and Airbus can successfully occupy a large market in the aviation field shows the importance and necessity of subsidies for the aircraft industry.Because the aviation industry has the characteristics of high investment,high risk and long return period,it is impossible to compete with other aviation powers only by relying on the strength of enterprises.If you want to develop the civil large aircraft industry,you must have government subsidies and a lot of investment.On the basis of this point of view,it proposes to avoid prohibitive subsidies,adopt non-specific subsidies,focus on research and development subsidies,improve its compliance review system,strengthen research on subsidy rules,and improve the subsidy legal system to improve China’s civil large aircraft subsidy mechanism.,in order to promote the sustainable,healthy and rapid development of my country’s civil large aircraft project.
